Hello,

So, I came here as an international student and will be graduating soon in August 2023. My wife is on an open work permit and our permits will expire in November 2023.

I already have an NOC A permanent job offer letter with 3 payslips. What I don't understand is how does her extension will work. Do I apply for my PGWP first and then apply for her extension for OWP? Or is there an option to apply together.

Furthermore, I was told by a immigration consultant at my University that if she applies for her work permit extension when I apply for my PGWP, she will not have implied or maintained status, so if the application does not gets approved before her current permit expires, she would have to leave, but if she applies after I get my PGWP, she will then have maintained or implied status. Is this true?

You can apply together

If you apply after your PGWP, she will need to apply for restoration as well

Good Luck

I understand we can apply together, but what if her original permit expires, will she be allowed to stay on implied status because my university immigration consultants say she won't be on implied status.

Without an application she cannot maintain implied status
She needs to apply for a restoration in other applications, if she fails to maintain status else she will be refused

I am sorry if I have been confusing which I think I have been from my previous reply.

So after I apply for her extension at the time of my application for PGWP, will she have a implied status?

When you submit your PGWP application, you get a letter 24 hours later called the WP-EXT. This letter grants you the "implied/maintained status". If you apply for her extension along with you, you'll both get the letter.

This is what we did when I applied for my PGWP. I included my wife's SOWP application in my PGWP application and she also got the WP-EXT letter.

How did you include it? Did you apply on paper or online? Is there a question like is someone coming with you while filling the PGWP application? My wife has a seperate GC key account from mine, will she get her letter there? I just want to understand how this works

Yes, when I came to the question "any dependent coming with you", I answered yes. I applied online. This was also what my DLI's International Students Office advised when I finished my program and was about to apply for PGWP. I submitted an SOWP application for my wife so that she can continue working and applied for a visitor record for my son (it was during the pandemic and all classes were online and my son did not want to attend post secondary online).

So just to confirm, using this option, both of you got implied status? The reason I am asking this is because the immigration consultants at UWaterloo told me that she won't have implied status if she apply this way but if I apply for PGWP, get it before her current work permit expires, apply for her extension based on my PGWP, then she will implied status

Yes, we both got implied status. And I applied for both based from the advise of the International Students office of my DLI.

So, your DLI has an immigration consultant in-house?
