should I rely on the Embassy or the application portal for my application status?

Hi there!

So, I am applying for a study permit, and I have been told by my lawyer that I am on "Eligibility stage" right now, which has to be done in order for the background stage to start.

I have contacted the Embassy through IRCC webform, and they told me that my file is going through a mandatory background check, while my application portal says I am still in the eligibility stage, and background check is not yet started.

Who should I count on to determine my application progress?

You should just wait to see items completed on the portal, and items can be delayed in appearing on the portal. Only thing you can do is wait. How long ago was the app submitted?

I submitted it on May 31st (Application)
June 25th (biometrics)
Upfront medical exam was submitted as well, but they requested it a week ago, perhaps they did not notice it. I reuploaded it and they have acknowledged that they got it.

IRCC processing time is 6 weeks, now I am at 8.5 weeks. Assuming processing starts right from the start of online submission?

Do you think it could take more? Problem is my semester starts on September 6th and last day to attend is 10th of September. Deferrals are only available to next Fall.

Unfortunately published processing times are averages, obviously yours is more and that could be for many reasons. Looking at the date of submission and BIO request I would say it wasn't started processing until closer to the bio request date. That usually happens very early in the process. Hopefully they will speed up the processing but I think you should check the last date and process for deferral if it comes to that.

I would say, the embassy probably gave the most up to date status if they’re the ones working on your case… the portal might take some time to update. Also, you can check with other people going through the study permit application process here and check if they’re experiencing something similar or taking longer than expected https://myimmitracker.com/en/ca/trackers/study-permit-tracker
