She shouldn’t have gone to Dubai. You must be in Canada and living with you to qualify for the OWP. It looks like she has been in Canad for 3 weeks but abroad for around 4 weeks. When does she plan on returning? The point of the program is to allow spouses to permanently live together during the sponsorship program. The OWP is to both allow the couple to support themselves in Canada and try to meet the needs of the labour market. Has she informed IRCC that she is abroad? When is she planning on returning. A short visit may have been overlooked but she seems to have visited you in Canada while living in Dubai for the majority of the sponsorship.
Also to add.. we waited for TRV to get approve. once we got visitor she travelled and at same time Sean Fraser announced new reunification policy. When we applied for Visitor there was no OWP policy for spouses. So she travelled here spent 3 weeks and we applied OWP while she was here. she went back as we thought once OWP will approve she will travel back to Canada

It's a new enough policy that I doubt anyone can tell you for certain. Short form is that it is probably a mistake to have her wait until she gets the OWP to return - the OWP is intended for those who've arrived and want to work.

What we can't tell you is how long it will take (I haven't seen even one issued yet, but probably missed) and whether remaining abroad will cause IRCC to decide the app has been abandoned. They could.

Did you get AOR or any email/documentation regarding your TRV? If yes, that means they have started working on your application.
You may want to inform them right away, however CIC does NOT include TRV fees in the list of fees which can be refunded. here's the list:

After we start processing your application, only these fees can be refunded

  • the right of permanent residence fee (RPRF)
  • the right of citizenship fee
  • the open work permit holder fee (for Labour Market Impact Assessment (LMIA) exempt workers only)
  • the employer compliance fee (refunded to the employer)
International Experience Canada (IEC) fees (See refunds for IEC)

I didn’t receive any AOR for my TRV (applied on June 7), but I received PPR last week for my spousal application.

Seems like it is not refundable as per your list above.

Even if they don't, (which is highly likely that they do have access) they can ask you if your spouse is IN canada and you cannot lie about it once asked.
That's misrepresentation and could result in a 5 year ban.

For the bank statement, do I have to print statement for the past 3-4months with a certain amount in the account or I can also transfer money to the account and print the statement ?

On the contrary, i guess there is nothing wrong here. Since your wife entered Canada on a TRV and returned before expiry of TRV - she is 100% in line with CBSA expectations at the time of entry, as we have seen recently they do ask for return tickets even if you have Spousal PR application which has got COPR in email...even then they ask for return tickets. They dont send you back if you dont have one, but they do ask. So somewhere in CIC, there is that expectation that visitors must honor the principles of TRV. And this is exactly what your wife has done. Or at least this what she can argue.

Yes she has applied for OWP - and that also does not change a thing! Why? Cuz OWP hasn't been granted yet and who knows if its going to take 30 days, 60 days or 18 months! Who knows. Plus, she legitimately had to return back and complete the unfinished business - resign, take care of other stuffs etc.

Infact, if anything, CIC would actually respect her for honoring the TRV - she used it only to briefly spend time with her family while her Spousal PR was being processed. And now hopefully, when she is returning, her spousal PR would have atleast progressed to PPR stage. I guess even if its COPR - she can still enter Canada on her TRV (if it was multiple entry). And then do the virtual landing while she is Canada.

Absolutely, currently waiting to receive the AOR as we've applied back in March. The moment the AOR gets here we are submitting the TRV immediately. My question is whether we can apply without having received the AOR or we should have received the AOR before applying for the TRV under the new mandates?
New to this, me and my fiance are looking into this whole process. I'm Canadian, she is Philippino

It's an important milestone and usually comes about 2 months after you submit your wife's application. It's important because it means the application has passed an initial screening and appears to be complete. Until you receive AOR, you cannot be sure the IRCC won't finding some defect or something missing in your application and it will be returned, leaving you to start all over again.

I have returned to edit this post. I referred to "your wife's application", but notice she is your fiancé. You get the idea. I won't change the wording of the above paragraph.

A small point of language, and as someone with a gf from the Philippines, you should know that she is "Filipino", not "Philippino". A common error and quite understandable. Carrying on, a male Filipino is a Filipino. A female is a Filipina. But both are Filipinos, if that makes any sense. :)

Excellent summary. I'd add two points of significance (for most):
-the applicant's file at this point is formally in the computer system and has a file number/reference that will be used for most things. It should also be possible at this point - usually - to find the file and link it in the computer systems such as gckey that are open to applicants and sponsors (albeit that those systems are not great).
-For most spousal sponsorships, a number of communications will usually follow the AOR (although timeframes vary, and sometimes these docs are combined): sponsor approval (not all, may be in aor letter), biometric request letter (for those what need 'em), medical request in particular. The latter two obviously require action on the part of the applicant. Some are advised which visa office (eg abroad or in Canada) will handle their file.

This flurry of activity is often followed by long periods of little or no communication from IRCC, so don't get overly excited.

I know saying it's 'officially in the system' does not sound that significant, but among other things, it SEEMS that this may be essential to getting evaluated under the new TRV policy for spousal reunification (which is still not a guarantee).

So very true! Early on, it can appear that the process is proceeding apace and all is peachy. But then comes a long period of apparent inactivity that can be a bit hard to take. Long periods of hearing nothing, leading one to conjure up in one's mind all kinds of negative reasons for the prolonged stoney silence.

To further this topic, after the flurry of documents, namely AOR, SA, BIO, Med Request --- comes the silence.
But its not really silent either - unless you want it to be all silent. You can make your own noise...how?
TRV!!!! Yep! Prepare your TRV as soon as you get AOR + SA - and send it off. With 2-4 days you will start getting more communication related to TRV. And if all is ok in your application, you should be getting PPR anywhere from 2 weeks to 2 months.

And by the time you will be done with your TRV, PR tracker will again get your focus, by some ghost update, Eligibility or Background verification update...followed by COPR and PPR.
