Hey guys,

I got this reply from IRCC saying that my physical presence is less than 1095 days.


Your application for Canadian citizenship is incomplete. We cannot start processing your application for the following reasons:

Physical Presence
In the calculation, you have fewer than 1,095 days spent in Canada during your 5-year eligibility period.
To fix this issue
  • Wait until you have 1,095 days or more in your calculation

Hmm... When you filled your dates in the Physical Presence Cal. at the time of filling your application you may have seen the # of days showing. Do you remember what it was?

It was showing 1097 days while submitting for the first time. Now, it is showing 1127 days.

Okay. The PP Calculator is pretty straightforward. As long as you are inputting the right dates, you are not missing anything.

However 1097 is pretty close to 1095. Would you want to give another thought in case you had a day trip(s) to the US after or before you became PR.

Seems okay.

Just recalling one post from this forum where a file was returned as the applicant had applied in a different time zone (than EST, I think) and it changed the calculation after the application was submitted (took a day out of the calculation). But that was a one-off kinda situation.

Just recalling one post from this forum where a file was returned as the applicant had applied in a different time zone (than EST, I think) and it changed the calculation after the application was submitted (took a day out of the calculation). But that was a one-off kinda situation.
I think my mistake was saying no to "During your 5-year eligibility period, did you leave Canada for any reason? For example, vacation, work, business, family matters, school or illness.". I specified travel information on optional document but still they returned my application.

I think my mistake was saying no to "During your 5-year eligibility period, did you leave Canada for any reason? For example, vacation, work, business, family matters, school or illness.". I specified travel information on optional document but still they returned my application.
Oh yes! That is it. You gotta those Germany travel dates in the physical presence. Sorry, I was assuming you already did that and even then your file was returned.

Date application was made is key information. Obviously, if you made the application prior to May 29, 2023 you were in fact short as of that application.

If you made the application after May 29, 2023 (although obviously it would have been prudent to not make the application until mid-June at the earliest, to have a buffer over the minimum), it appears you have made some kind of error in populating information in the physical presence calculator.

Hard to guess what sort of error you made. But, just as an example, it appears you may have made an error in stating the dates of your temporary status, as you clearly have in what you posted here. Even assuming you made a similar error in your application, I am not sure how that would have affected the physical presence calculation. (Error in post here is that your extended student status expired March 30, 2020 when that had to have ended/expired as of November 4, 2019 . . . that status expiring upon obtaining worker status.)

That said . . .

It was showing 1097 days while submitting for the first time. Now, it is showing 1127 days.
If the information entered into the physical presence calculator is the same, it should give you the same total regardless when you do the calculation. If not, clearly you are making some sort of error in entering the information.

If this difference (1097 before, 1127 now) is based on different information entered into the calculator, the first based on the date you made the application and the second is based on doing the calculator as of now, I cannot explain why the first totals 1097, or the second, as of today, totals 1127, but the latter clearly indicates you are making some kind of error in what you enter into the calculator.

Since you landed May 28, 2021, and have not left Canada, your presence as of today as a PR totals 782 days; you appear to be entitled to the maximum 365 days credit for pre-PR days. Giving you a total of 1145 days as of today. So, yeah, it appears you are making some kind of error in the information you enter into the calculator.

Just as a point of reference, your presence calculation would only total 1097 if you made the application May 31, 2023. That would give you 732 days credit as a PR plus 365 days credit for pre-PR. So, again, just as a point of reference, if your first calculation totaled 1097 and you made the application on any day other than May 31, that makes it clear you have erred in entering information.

NOTE: the most common reason for applications returned as incomplete based on applicant not meeting the 1095 days presence requirement is because the applicant is claiming temporary status which is not documented in their GCMS. This is usually about visitor status not documented by a visa or visitor's record, or a period of implied status.

I was on implied status after completion of my study. So, what should I do on that part? I applied work permit on July 15, 2019 and started working on implied status till I got work permit on November 4th, 2019. Please suggest.

Note: it is imperative to rely on the presence calculator, but to do that it is absolutely necessary that all dates be accurate. Making arithmetic mistakes is all too easy . . . I made one in my previous post, for example, when I said:
"Since you landed May 28, 2021, and have not left Canada, your presence as of today as a PR totals 782 days; you appear to be entitled to the maximum 365 days credit for pre-PR days. Giving you a total of 1145 days as of today."​

That total is wrong. My error. It should be a total of 1147 days. 730 days for May 28, 2021 to May 27, 2023, plus the 52 days since then (not counting today). The online calculator will not make that counting mistake.

Leaves open how you got the numbers you referenced:
"It was showing 1097 days while submitting for the first time. Now, it is showing 1127 days."​

Your physical presence calculation could be 1127 ONLY if the application date was June 29, 2023.

I am not entirely clear about your status or the dates (I do not follow, for example, what period of time you were on implied status). And I am not an expert and I am not qualified to offer advice.

So, in terms of suggestions, I cannot suggest what particular information you should submit. All I can offer is to be truthful, accurate, careful, follow the instructions, triple check all information entered, and be precise as to dates of pre-PR status based on DOCUMENTED status. Which means clearly distinguishing periods of implied status. Periods of status pre-PR should not overlap.



Resubmitting Application:

If and when you resubmit, you can and probably should submit a new application (I quite sure, but not for sure certain, you can still apply the fees paid to this) with a new application date which will give you the additional days credit for the days you have continued to be in Canada in the meantime. (Remember to have a good buffer over the minimum; many suggest a mere week to ten days, but to my view a month buffer is a good idea.)

If you do that, be meticulous, working your way through the forms including the physical presence calculator, and again be truthful, accurate, careful, follow the instructions, triple check all information entered, and be precise as to dates of pre-PR status based on DOCUMENTED status. Which means clearly distinguishing periods of implied status.

If you do this, there is no compelling need to figure out where you made the mistake in the previously submitted application that caused an error in the physical presence calculation.

To cross-check your work and the output (what the calculator shows as totals), if you still have not left Canada since you became a PR, the total number of days for time in Canada as a PR is easy: 730 plus the number of days since May 28, 2023. Which as of today should be 782 (not counting today, which is how the calculation works); that is, 730 plus 52 days May 29, 2023 through July 18, 2023.


Figuring Out Error as to Presence Calculation:

If you really want to figure that out, as noted before the most important factor is the date of the application. And then to be precise in entering all the information in the physical presence calculator (which for this purpose includes the application date for your first application).

As noted above, you do not indicate what application date the calculation of 1027 days is based on. Since you landed May 28, 2021, and have not left Canada since then, that would be accurate ONLY if it is based on applying June 29. So if that calculation is not based on an application made June 29, you are clearly making some kind of mistake entering the information.

Caveat Regarding Pre-PR Credit:

It appears that you should easily qualify for the maximum 365 days pre-PR credit, having spent more than 730 days in Canada with pre-PR status and within the five year eligibility time period. But getting this credit depends on your status being documented in your GCMS records. Given what you say about pre-PR status, it is not likely this was or is a problem, but stuff-happens. Probably better to just proceed with a new application being more careful than the first (yeah, checking "no" about leaving Canada when you had, that was a significant mistake), applying with a bigger margin, and see how that goes.

I do have option to resubmit the old application. Thank you for the suggestion though. My biggest mistake was missing checking "no" about leaving Canada and I have corrected it now. In my last application, I specified that under optional document section. So, I do not see any problem on that. Hope it will be accepted. Since, I mentioned that but forget to include that under proper section.
