LGBT common-law partner won't go with me to Canada for now

Hi guys, I'm applying for Express Entry now and I'm in the pool (I chose "No" to the question "Does your spouse or partner plan to come with you to Canada?" in the Express Entry wizard, and common-law in the marital status). But my boyfriend won't come to Canada with me for now (he'll come maybe one or two years after I become a Canadian permanent resident), and I've been working abroad since we were in relationship, we're basically in a long-distance relationship, it's hard for us to prove one year of living together.

I'm wondering if IRCC will ask for documents to prove our common-law relationship when I get invited, and since I chose my partenr not to come with me to Canda, will it be a problem if he applies to join me after I get PR.

P.S. in my country, the same-sex marriage is illegal.

So you are not common law if you have never lived together continuously for at least a year. Yes, you have to prove you are common law with proof of living together continuously for one year so leases, utilities, bank accounts, taxes etc. You are considered single for EE purposes. After you get PR, you could a) marry, b) apply for TRV and then come to Canada and live in Canada until common law or b) apply for conjugal sponsorship if you didn’t marry and TRV was refused.

Have you lived together for one year continuously or not? When you say it's hard for you to prove one year of living together, is this because you didn't live together for one full year continuously (without breaks) or because you did but there is a lack of evidence to show this?

We didn't live together for one full year without breaks, I basically work abroad and I only live with him when I'm back to my country, like 2 months per year. So I think I'd change my status to single

Then you definitely aren't common law. Yes, you need to change your status to single.
