Hi,

One of my friend's is applying for PR under Express Entry CEC stream.

She is legally separated but still waiting for final divorce ruling from court. In the meantime her marital status is legally Separated. While filling info in Express Entry application should she add her ex-spouse as a family member as she is still not divorced yet?

Any insights on the matter will be appreciated.

Once you mention "Spouse not-accompanied", your application shows only one applicant. There definitely will be some details of spouse required however those will be visible under tabs while creating an express entry profile, so go with the flow. She may still have to get Medicals and PCC for her spouse.

If your friend is legally separated and waiting for the final divorce ruling, then she should not include her ex-spouse as a family member in the Express Entry application. In the application, the definition of a spouse is someone who is legally married to the applicant, and a common-law partner is someone who has been living with the applicant in a conjugal relationship for at least one year. Since your friend is neither legally married nor in a common-law relationship with her ex-spouse, she does not need to include them in the application.
