Tricky Work Experience Situation

Hi all,

Need your advice on my wife’s situation please, she is the main applicant to our application.

She has education diploma of 3 years in nursing, and her 10 years of experience in the last 10 years, as follows:

2013 - 2014: Nurse, NOC 3012
  • Work experience outside Canada
  • No practice of this occupation for 8 years now
2015 - 2016: Business development officer, NOC 4163

2017 - present: College & other vocational instructors NOC 4021
  • Started as freelance French instructor then converted into a French language center with official paperwork, now is a business owner and a French instructor in corporates
  • Can proof ongoing clients’ payments and clients’ statements through bank transfers since 2018

A few questions:
  • Can she apply with the nurse NOC in EE?
  • Can she apply with the nurse NOC in PNP’s?
  • If we receive an ITA, is it not suspicious for the immigration officer to see that she is applying with a main NOC that she did not practice in 8 years?
  • Regarding NOC 4021, can she apply as an instructor, or should she change the NOC to be business owner and use it?

Nurse will most likely not be a possible occupation for EE since her year of work experience in this occupation likely falls outside of the 10 year period or soon will. Exactly what where the dates of the nursing experience?

Nurse was from 2009 till July 2014.
Our ECA is ongoing and should be completed by May/June, so should still fall within the 10 years period, correct?

No, not necessarily. The dates are going to be important. You need to still have the 1 year within the last 10 at the time the application is submitted after you get ITA. So it depends on the timing of everything. You would need to receive ITA and submit the complete application before the day in July that she stopped working in this profession in 2014.

got it, thanks! but do you think we can go ahead with a main NOC although she hadn't practiced the job for 8 years and not raise any questions or get the application declined? I don't want to go all the way then get refused.

I can't guarantee that. I'm not IRCC.

I don't remember any exactly like yours.
Thanks a lot, appreciate your quick responses.

One more thing please, if we decided to go with NOC 4021, teaching French to companies and corporates (not school of college students), my wife doesn't have any certificates of teaching French, however she's a fluent speaker as it's her native language. Could not having a certificate for this job cause any issues?

This is the NOC's employment requirements:
  • A bachelor's degree, a college diploma or demonstrated expertise in the field of instruction is required.
  • A master's degree in the field of instruction may be required.
  • A certificate, diploma or degree in adult education may be required.
  • For instructors of trades, completion of apprenticeship training and industry or trade certification are required. Additional courses in teaching or a provincial teaching certificate may be required.

427 does not stand a chance unless Bill C19 gets implemented and they start targeted draws. I am claiming points for foreign work experience in NOC 21231 from year 2013 to 2018 and 2022-2023 (CEC experience). I will let you know once I apply if i get any question from IRCC regarding having a break in NOC
.I would suggest to look for PNP route ASAP. I am not expert on PNP so cannot speak for it.
