Hi everyone
My mother(the spouse) was the principal applicant of family class sponsorship for Pr application outside canada.I and other 2 sisters are included as dependent children of her(our father died before)on the application ,now our application are closed to the final stage to make decision. But unfortunately our mother passed(PA) away recently, which shoked us a lot.my question is here
What will happen to our application without our mom(PA),since he(the sponsor) is not our father,we are just her children from other?
Does visa officer rejected our application for this?
What should we do without principal applicant?
PLEASE share your idea in detail

I'm very sorry for your loss.

The application cannot be finalized in this situation since your mother is the PA. She must land and become a PR in order for you and your sister to get PR. Without your mother, you cannot get PR through this application.

The one option I can think of is for you to try requesting H&C considerations however I'm not sure if that would work since (as you've said), the sponsor isn't related to you. If you want to try to go down this path, I would recommend you get a consult with a good immigration lawyer.

How old are you? Do you have a parent-like relationship with the sponsor? Are you living with him by any chance already? Is your father deceased or still alive?

Your sponsor needs to speak to an immigration lawyer in Canada. This is a complicated situation.

The sponsor does not qualify to sponsor you and your sisters directly since you are not related to him. You could only be included in the application as dependents of your mother. Without your mother, he cannot sponsor you.

The only option I see is for your sponsor to request Humanitarian & Compassionate consideration. It is very important that your sponsor do this. You cannot do this. It is also impossible to say if this will work or not. The application may still be refused. I would again strongly recommend that he get help from an immigration lawyer.

Would add that the sponsor is required to inform IRCC of your mother’s passing if he hasn’t already. Not doing would be misrepresentation. If he hasn’t you are required to inform IRCC that your mother passed. Have you spoken to your mother’s husband and asked whether he will be willing to sponsor you and support you guys financially? If he is not willing to do so that will complicate the situation. He really needs to be the one who consults with a lawyer to try to get your application considered under H&C. If he is not willing to sponsor and support you three the situation becomes much more complicated. How long has your mother spent in Canada? That will also likely be a factor.
