Dear Friends

I have few queries:

1. Do we require LMIA to apply for work permit?

2. If yes, what is the validity of LMIA?

3. What are the grounds on which work permit can be refused?

4. Do we get Open Work Permit or a person needs to work in Canada in the same profession in which he was working in his home country?

Thanks and Regards
Shivani

1. Generally yes.
2. Do you mean the validity of the work permit?
3. A number of reasons. One includes if the job you plan to take in Canada doesn't match your previous education and/or work experience.
4. I don't understand this question. Open work permits are only available in limited circumstances and if you meet certain criteria. If you qualify for an open work permit, you can work in any profession.

Hi syclla

thanks for replying.

No, I was asking about the validity of LMIA only because I guess it expires after some time but I don't know its exact validity period.

My questions were in regard to one of my friends. He has 5 years of work experience in India and he only wishes to take job in Canada which matches his job profile here. But he wants to be aware of any other grounds of refusal before he takes the plunge into this entire process. I mean any other factors besides this that you may be aware of will be useful.

Regarding my last question I often hear the term 'OPEN' Work Permit which i guess means that you can work in profession even other than the profession in which you have experience. Am i right?
As far as my friend is concerned, he is just interested in Work Permit that allows him to work in his related job in Canada.
I asked the question for my own knowledge only.

Regards

also if you could be tell me how long does it take LMIA to process?

and are there any job sites where my friend can submit his CV

if any employer shows interest in CV and wishes to hire someone, then does employer approaches government for LMIA on his own?

- LMIA can take anywhere from a few weeks to over six months
- He needs to apply for jobs directly through sites like indeed and linkedin or through employer sites directly.
- Yes, the employer needs to obtain the approved LMIA.

No - that's not quite what an open work permit is. An open work permit allows you to work for any employer in Canada. Closed work permits are tied to a specific employer and job.

Open work permits are only available in very specific circumstances. Based on the information you've provided about your friend, he does not qualify for one.
