Spousal Work Permit Suggestion?

Dear Friends,

I have bit special case, I have arrived to Canada along with my wife and kid on visitor visa and my wife hold study permit at that time.
Later on, I decided to apply for the spousal work permit, which I obtained but I got an opportunity to do PhD at her university. I applied for the study permit later on.
Our both PhD is fully funded and we are on the scholarship, my current study permit have different expire than her. She had Post graduate work permit in the past so she cant apply for the PGWP again. This is her second degree from the Canada.

Situation Right Now: She completed her PhD and she got the job offer which is also LIMIA Exempted. Currently she is on the student permit and looking to complete admin process of her PhD certification. She is not sure if she can apply for the work permit under mine which shall allow her to get the open work permit. Her employer said, she can get the close work permit but its better to have open one.

We have ask this question to IRCC customer care they say, you fill the initial details on the IRCC website and it will show you are eligible or not. I filled it shows eligible but no confidence if I should go ahead. One of her friend told that she cant not apply for the open work permit since she is on the study permit. I looked the IRCC eligibility, I think she must be eligible under mine study permit. I am not sure if I can apply for her Open work permit under my status? any suggestion will be very helpful?

She doesn’t qualify for an OWP. Her only option is a closed WP. IRCCsupport line isn’t reliable for advice you should speak to a lawyer if you want advice. She is no longer eligible for an SOWP because rules have changed. Too many couples were alternating between studying and working and repeating the process over and over again to extend their stay. The primary study permit holder doesn’t qualify for a SOWP if the other spouse then starts studying in Canada . PGWP is a one time thing.
