Visitor Visa Refused

Hi,

I am a temporary resident in Canada on work permit. My wife is also on work permit and daughter is on study permit.

I have moved to Canada on an intra-company transfer. While applying for work permit from India, I didn't apply for my elder daughter because she is studying there in her BCom (second year) and wants to complete it from there. 1.5 years still remain in her graduation.

I applied for visitor visas for my elder daughter and mother on 17-Oct-22 and both have been refused citing that they do not have enough reasons to return. Whereas they have very strong reasons to return to India.

1. Daughter: Pursuing BCom from a premier institute in India (Symbiosis College of Arts and Commerce, Pune ). She has completed 3 semesters and 3 more remain. I furnished a letter from her college stating the same. She didn't move with rest of the family because she wanted to complete graduation from India.

2. Mother: She is a retired teacher. She gets a very handsome pension and also has immovable property. My younger brother and his family live in India.

Both have very solid reasons to return but their visas have been refused citing that they do not have enough financial resources and family in India for them to return.

Please help me with the next steps. We are very distraught with this development.

I would reapply for one (whoever is the priority) and not both.

Daughter for 3 weeks and mother for 3 months. I would reapply for daughter, but I don't have anything new to add - she is a student and doesn't have significant funds/property in her name in India. Her immediate family (myself, her mother and sister are in Canada). She didn't move due to her studies, and I mentioned that very clearly in application. I attached a letter from her college corroborating it.

Please suggest what new information I can add.

What evidence did you attached to the application to show her studies? Just the letter from the college or more?

I would attach evidence that you have already paid her tuition for the next semester. If she can get a marksheet / transcript for her studies completed to date, attach that too.

Where is she living? If she happens to be renting an apartment / flat, show evidence of this too.

How old is your daughter? If she is nearing 21 there may be concern that she will try to remain in Canada because after 21 she will not be able to immigrate with your family. What funds was your mother able to show to support her visit? Especially liquid funds. A 3 month visit is a long visit especislly since you are on WPs not PRs. Looks like you only recently moved to Canada so asking for such a long initial visit so soon after moving may have been a concern for your mother. How soon after landing did you apply for the TRVs? Having your brother and his family in India are not strong family ties since they aren’t her dependents. Do they all live together? If they all live together that would show more of a tie than not living together. Does she have a travel history outside of India especially to places like the UK, US, Australia, etc.?

My daughter turned 19 in September. She has a travel history to France and Switzerland.

I am planning to reapply only for my daughter first - will that be a wise move? If yes, please suggest what documents all should I attach?

I have added the following -

1. My assets in India (worth about CAD700000)
2. My daughter's course fee receipts (up to 4th semester)
3. Marksheet for first two semesters
4. Transcript for the whole course
5. She is also pursuing ACCA (Association of Certified Chartered Accountants), and has completed 6 of 14 course. Details of that.

Please suggest what else should I attach.

1. Letter from college corroborating that she is a student and have passed three semesters. And three remain.
2. Letter from college approving leaves and NoC for travel..
3. Proof of fees paid
4. Transcription of courses - and the ones she has cleared
5. Marks-sheet of three semesters
6. Documentary proof of immovable properties in India in my name
7. Documentary proof of my investments in India (shares, provident fund)

Please suggest whether I should attach any more supporting documents.

Your mother does not have strong ties. Her ties would be a spouse and children under 22, job with approved leave, investments and investment properties. If she gets a pension, can money only be deposited if she is in India. If so show that documentation. If not, she can have a pension and live anywhere. Her other son is not a tie.

Your daughter is single and all her family is in Canada. That is the reason for refusal. Single, mobile people applying for TRVs have a very high chance of refusal. Attaching proof of tuition, letter for her are all she can show if she doesn’t have a job. Not sure how 5 and 6 proves ties. Those are not her funds or your mother’s.
