Hello All!.

Any input or information on this scenario will be appreciated.
My father overstayed during his last visit to canada on work permit due a some misleading information from an immigration consultant.
I have applied for his visitor's visa now and wondering if it is going to affected his file in any ways.
There were the questions asked in the questionnaire and the answers i have provided :

worked without authorization in Canada?

Provide as many details as possible about when that
happened and why. This will help with processing your
application.


I was on work permit in canada for the duration of 20-April-2012
to 30-June-2013. When i work permit expired, I applied to the
extension of work permit through an Immigration agent who
misguided me and informed that i could stay for the period when
the work permit extension is in process. I waited until 22Jan2014
for the new work permit with no news,I finally decided to return
to India as i was not getting any news for my work permit
extension request. It was a honest mistake made by me.

Visitor's visa Info : Applied through : https://portal-portail.apps.cic.gc.ca/home/application-status (I am not sure if this is the new portal or the old)
Biometrics - August 30, 2022: Completed.
Application received: August 21, 2022

I still have no response

Questions:
1. Has anyone applied a visitor's visa in a scenario like this?
2. Is this going to affect the processing of my paren't visitor's visa ? (Ps. I am permanent resident of canada, Living in montreal since 9 years now)

Given the overstay a VO will likely have to review the application which is likely why it is taking longer. Yes an overstay can have significant implications. Are your parents retired? How long have they requested in terms of length of stay? Do they have enough funds to support their own travels? There is a good chance that if granted a visa it will be for a a few years to see if they can follow the immigration rules.

Are your parents retired?
Yes they are retired and I have uploaded their Bank statements of multiple banks showing enough funds (Around $20,000)

How long have they requested in terms of length of stay?
His work permit was for the duration of 20-April-2012 to 30-June-2013. He left on 22Jan2014. So we can say that he overstayed for 7 months. But his file was under process (LMIA).

Do they have enough funds to support their own travels?
They do

Here is a good chance that if granted a visa it will be for a a few years to see if they can follow the immigration rules.\
If this is the case, It would be fantastic.

Employer applying for LMIA doesn’t give your father any status.

Do they have enough funds to support their own travels?
They do

If this is the case, It would be fantastic.

Definitely no guarantees of approval but if approved getting a shorter visa versus 10 years is fairly typical if there is any concern about an application. All you can do is apply and hope for the best.
