Hi @legalfalcon - I am in a situation.

Received ITA on 26 October and have to submit documents by 26 December, 2022. My PCC is already in progress but I doubt I will be able to get PCC by then.

The real issue is my IELTS expired on 28 October but I have 2 other IELTS as which are expiring December 12 and 22 December (as per result date). In both of these IETLS, my score reduces but still above the cut-off in which my file got picked up.

What would you suggest here:

A) Submit the file before IELTS expire with LOE for PCC
B) Give IELTS again and get the score again
C) Any other solution which you'd suggest?

Hi @legalfalcon I have a quick question. When I submitted my application, I submitted my pcc for both India and USA. It's been 20 months, if i want to do upfront pcc, i know that i have to India PCC again but should i do USA pcc again?

Unless you have been asked for a PCC, you do not need to submit it. The rules for PCC are as follows:

  • For the applicant’s current country of residence, the police certificate must have been issued no more than 6 months before the submission of the e-APR.
  • For countries in which the applicant no longer resides, the police certificate must have been issued after the last time the applicant stayed in that country for 6 months or more in a row.
  • Police certificates meeting the above requirements can be accepted even if they have an expiry date that has passed.
  • This includes the requirement to provide a police certificate for countries in which the individual has travelled for 6 months or more in a row, whether or not the individual had an established residential address during this time.
  • Police certificates are required upfront and are mandatory for each country (except Canada) where an individual has spent 6 months or more in a row within the last 10 years. The individual does not need to provide one for any period of time before the age of 18.

If your country of citizenship is India, and in the last 20 months you have not visited India, i.e. after you submitted your Indian PCC, your previous PCC is still valid.

As regards the the PCC from the USA, if the US is your current country of residence, you can submit a new PCC, but as stated above, not required unless asked.

Quick question about the Dutch PCC.

The official “how to request a police certificate” tool for the Netherlands indicates that IRCC will issue me a letter AFTER I submit my PR application, which I can then use to get a Dutch VOG (their version of a certificate of conduct). The ministry of justice usually requires some kind of proof that you need a PCC, so candidates wait for an ADR. This doesn’t seem to strictly be required, and I was able to get the VOG by just applying with the required documents, and I now have the physical VOG.
There is a form upload field for the Netherlands PCC on my PR application. Would you recommend I just upload the VOG or should I upload a document stating that the Netherlands requires a letter from IRCC, then upload the doc after IRCC requests it via an ADR?
Would you recommend I mention in an LOE that I was able to get the PCC upfront without a need for an ADR?

Thanks so much for your response! I have the official Dutch PCC/ VOG that was mailed to me by the Ministry of Justice after I applied for it. Is there any harm of uploading that instead of asking IRCC for a letter for a document I already managed to obtain?

I have a question. I will be permanently landing soon and my wife will declare some pieces of jewelry. However, there is some pieces left in our home country and we will be able to pick them up only 1 year after hard landing. Will we need to pay taxes on those jewelers or is there some type of limit that is tax free?
When you land, you can submit a list of "goods to follow" with a description of the items that you will bring later. The CBSA officer will make a copy of the list, stamp it and give it to you and retain one copy for the file. When you return with the goods, make sure you have the stamped copy.

Also, if the jewellery if under a reasonable amount for one person, or under the exemption limit based on the number of days you lived outside Canada, you will not be taxed or subject to customers.

I just got gcms notes. It says that my application was approved on 30th June from Ottawa office and was sent to islamabad office on 4th of July. Islamabad office canceled copr and sent it back to Rroc and London office. I am really worried as it has been 5months since than.
I also called ircc on 16 Nov, they said security was passed but gcms is blank in front of security and eligibility is once again not started. Any help or your feedback will be highly appreciated.

Can you please tell me the rule for BWOP with respect to entry and exit from Canada?

My work permit is expiring on 15 March 2023 and I am eligible to apply for BWOP.

I'd be leaving the country on 28 December and planning to come back in the 1st week of March 2023. I am confused that should I apply for BWOP right now or when I am back in the country in the first week of March?

I am a canadian PR who has not yet recieved a PR card. I have a question. If I fly or sail into Canada from say USA, using a private plane or boat (owned by me), will I still need my PR card to enter Canada?

From what I know IRPA / IRPR actually confer a right for PR to enter Canada. Its only the airlines or shipping companies that have the legal obligation to check PR status of a flyer or traveller using a PR Card. If I own the boat or aeroplane used to arrive in Canada, do I still need the PR card? Can I travel to Canada using my CoPR and Provincial photo ID or driving license?

To be eligible, you must

  • live in Canada (and intend to live outside Quebec) at the time you apply for your BOWP
    • You can leave Canada while we process your application.
    • However, if you leave Canada after your work permit expires, you can’t work until your new application is approved.
  • either
  • be the principal applicant on your permanent residence application
  • have submitted a complete applicationfor permanent residence and passed the completeness check
    • Submitting a profile to the pool is not the same as applying for permanent residence.
    • Make sure you understand how Express Entry works.
  • have your acknowledgement of receipt letter
    • We send this letter to your account after we get your permanent residence application

If you meet the above, you can apply. However, a new permit will be issued to you when you are in Canada.

Also, you need a valid visa to return to Canada, so make sure you have that before you leave.

This usually happens when one of your documents may have expired and needs to be re-done.

You can send a webform, or ask a MP to inquire.
