Open Work Permit Refused

Hi everyone! I hope that you are all well.

Last June I have applied for the extension of my work permit, and this week I received an update regarding my application, which apparently was refused. I moved to Canada 12 years ago. At first I attended a High School in BC, then moved to Ontario for University. As soon as I graduated I started working, and since obtaining my initial work permit I have worked in jobs classified as NOC A and B.

I submitted an Express Entry profile last January, 2022. Since then I have heard nothing, simply because my CRS score is not good enough for current draws (I am at 460). Therefore, the question I have is whether I can apply for the extension of my work permit or not?

My initial work permit was PGWP, and my latest application for the Canadian Open Work Permit was refused. In their letter they stated that I have to restore my Temporary Residence Status within 90 days from the expiry of my temporary resident status. So, here are the 3 questions I hope you guys can help me with:
  1. In August, 2022, I received an automatic extension of my work permit until May 31, 2023. Does it mean that I am still a temporary resident in Canada?
  2. I don't have a LMIA letter, and I am not sure whether my employer can provide me with it as I work for the provincial government. That said, is there any other way for me to extend my work stay in Canada?
  3. Should I still restore my Temporary Resident Status although I have an automatic authorization that lets me work in Canada until May 31, 2023?

When did your PGWP expire plus any extensions you got due to Covid? When did you apply for OWP and on what grounds?

When did your PGWP expire plus any extensions you got due to Covid? When did you apply for OWP and on what grounds? If you were already out of status you wouldn’t qualify for automatic extensions.
My initial PGWP expired on September 5th, 2022. At first I tried apply for BOWP, but all I understood is that if I want to apply for Bridging Open Work Permit the process is the same and I any how will have to apply through open work permit. So, I applied for OWP on June 15th, 2022, two months before the expiry of my PGWP. I heard back from IRCC this last Saturday.

Extensions yes, automatic authorization to work until May 31, 2023. The problem is, however, this authorization does not restore my Temporary Resident status. I am so confused right now and not sure what I have to apply for anymore. Been in here for 12 years and this is the first time I got refused.

You didn’t qualify for a BOWP which is one of the problems. Based on the government website you don’t have an automatic authorization you must apply to restore your status and apply online for a WP. You are currently working without a valid WP.
