In my PR application, under section my martial status I have mentioned 'Legally separated' and my divorce is still undergoing.
For the question :
Has xxxx been previously married or in a common-law relationship ?
1) should I select Yes or No?

If I should select Yes, there are several questions popping up. I have concerns on 2 questions that pop-up (below)
1. 'Date previous marriage or common-law relationship ended?'
2. 'How did this relationship end?' with choices (Annulment, Divorce, Death of partner, Ended the common-law relationship)

Since our divorce is still in process, I don't have relationship end date as I am not yet divorced yet and have no answer to select for the question 'How did this relationship end'.

Please advise what I should answer in this section. Thanks in advance.

My two cents worth:

I would put married, put your spouse as non-accompanying, and write in your LOE that your divorce proceedings are still ongoing. If you have a document you can upload which confirms you've already filed for divorce, it would be good if you can provide it as well.
Thanks for reply However I can't put my status as Married cause the ircc system is asking for his medicals and PCC and I am sure he will not provide it to make my life hell. I already have documents for divorce proceedings and hence can only for 'legally separated'. My only issue is on how to answer those questions?

Yes my bad, i was actually going to correct my post. You should put legally separated.

1. Put the date you filed for divorce.
2. Divorce

Explain that your divorce process is ongoing.

Thank you for the reply. One question though. I saw some where that the question 'Have you previously married?' was notifying on whether I have been married previous to this 'legally separated' marriage. Is that the case? If so, I should put 'No' as this was my only marriage. Just confused.

You say Yes because you legally got married before.

Hi, I am in a similar situation. Could you please update on your process and how you managed this issue? Thank you in advance

I sibmitted saying legally separated as my case was ongoing during that time and I submitted with the proofs that mentioned that. Later I received divorce (thank god) and I submitted the divorce papers and ircc updated my martial status to divorced.

As long as you have proper papers, ircc will accept it.

Sorry again for another question, but what did you end up saying for the previous marriage question? Yes or no?
Confused as to whether they refer to a marriage before the one for which divorce proceedings are ongoing or one that would be previous to this one. Thanks in advance again!

Hi @mvneema10 would really find useful to know if you out yes or no to this question. And if you also ended up getting PR or is it still in process? In any case. All the best!

I submitted with no as while I was submitting the application I was still married and didn't have any records of previous marriage.

My application is still in process and waiting to here from them for a long time.

you are not legally separated until you are legally separated, in some immigration forms you have separated in other forms legally separated ,for the obvious reasons ,a letter of explanation mentioning that you are separated ,awaiting decision from the court or separated and never filed for divorced or separated after the court refused the proceeding will do the job ,transparency is the key for these issues
