Wife's TRV rejected - how does reconsideration work?

Hi forum people!
My wife's TRV was rejected and one of the grounds was our finances. We showed 180k but that was not enough (I guess). The other more obvious reason was that the officer wasn't convinced that she would leave Canada after her visa expires. She has a contract with a clinic (she is an Orthodontist) and she wont be able to leave for 1-2 years (as you develop accountability for patients and can't leave the midway during the treatment) so that's why we went for a TRV instead of an Outland Spousal application.

I'm looking into how reconsideration would work in this case. But is it even worth it? do they ever change their mind? It seems that for my wife, she will be forced to apply for PR Outland and hence she wont be able to see me in Canada until she gets that PR, considering her TRV was rejected.

Reconsideration is sort of an unofficial process. IRCC doesn't have to consider it but you can of course try. You would simply submit a webform requesting reconsideration along with your reasons why. None of us can predict if IRCC will consider it. Good luck.

Thank you. I just need to figure out what to fix before reapplying. And the rejection letter isn't specific enough. Ordered GCMS notes.

You say she can’t leave her work for another 1-2 years and spousal sponsorship takes 2 years. Why haven’t you applied?

Because not everyone wants to move to Canada without coming here and seeing how it is here first. She is an orthodontist and makes a lot of money back home. For her to move here would force her to start from scratch besides going through equivalency exams which is a 3 year process.

It seems that Canada will only let her in if she applies via Outland PR. This logic is hard to understand because you are effectively blocking someone from entering Canada without being a PR, simply because she is married to a Canadian PR. Wtf

Unfortunately IRCC assumes that spouses will move to Canada, and not just come for a visit. The fact is that is what most people do so you are in the minority of the very few. You can apply for reconsideration and wait for GCMS notes.

Yes that's what I'm concluding here as well. Maybe applying for Outland PR followed by another TRV might get the job done. It's the only combination I can think of now. The sad part is that she has an exam on Feb 1st and she needs to be physically here for it. Hence, I'm hoping to do reconsideration and reapplication at the same time, if possible. Yes it's in Canada, Feb 1st and Feb 2nd. The rejection came on the 15th and we got the approval for this exam yesterday so it wasn't mentioned in the application. I'm not sure if I can use this now in the currently rejected file as this would be new info that wasn't in the file when we filed it.

The original TRV request was really basic. A visitor visa to visit and spend some time in Canada with husband and get to know the place more. I wish I had a better reason. Maybe we were too truthful and boring in our application! Lesson learnt.

You are contradicting yourself. If she hasn‘t decided whether she is interested in moving to Canada she wouldn’t have applied for any exams. The fact that she has an exam for dental or orthodontist licensing in Canada and you haven‘t filled out outland sponsorship points to the fact that she is going to move to Canada and has taken active steps to relocate plus you want to apply for inland sponsorship because you haven’t applied for outland processing. Assume she may have applied for a TRV soon after your marriage as well. Her finances seem fine if she has 180k but there will be strong concern that she has no plans on leaving Canada. Needing to be at her practice to ensure continuity of care isn’t a good reason because people leave practices all the time. That would only work if she stopped taking new patients now and only worked to finish up her current patients. I’m sure she’s not turning down patients because their treatment plan is 2.5 years.

If she is taking an exam in February then she is planning a move. Start the outland sponsorship process. Taking an exam to continue her profession. will show to officers that she has no plans to leave.

My application received 'Biometric Validity Letter'' same day my wife's request for passport letter was sent and still waiting on the decision. Even though it's not yet 24hrs but I am just worried. What do you think?

Nope, she doesn't. Though I got a response of a refusal 24hrs after receiving the Biometric confirmation email.

Interesting. A passport request, then refusal in that short time.
