Family members vs Dependent child....

Questions please if the team here can help answer:

-We are family of 3 (husband, wife and son).
-Sponsoring my mother (father passed away).
- I have no income but savings of 30K. My spouse will be cosigner and have income of 90K each of the three years.
This should be ok right?


-My two brothers are 22 years old and 26 years old.
I believe they do not qualify as dependent. Any chance of making a case that my 22 year brother cannot live alone back home and due to father passing, it has affected him strongly. I would request if he can be considered as dependent). any chance IRCC will approve this?

Sometimes, they reference that need to put details for all family members 18+ and in Checklist, they reference all dependents who are 18 years of age and older.

Do I need to add details for brothers (22 yrsand 26 yrs) in form 5562.

There are certain income that doesn’t count towards LICO but at 90k for 4 people you should qualify even if you have to deduct some income. Your brother does not qualify to be sponsored with your mother.

The below is from the guide 5772, other than declaring as family member in the family info form, we should not submit a separate dependent section on IMM008 form, background declaration form, family information form, and travel information form, people who do not fall under spouse, dependent and dependent of dependent.

This is based on my understanding of the guide, and other official references. I highly encourage you, and other preparing application package, to read it throughly. Also, I would appreciate a lot if you, or other, could point out my understanding is inconsistent with the guide or other official references.

Dependant’s relationship to the principal applicant

Dependant type
Type A


The dependant is under the age of 22 and single (not married and not in a common-law relationship).

Type B (Important: This dependant type applies only if your child’s age was locked in before August 1, 2014)

The dependant has been continuously enrolled in and in attendance as a full-time student at a post-secondary institution accredited by the relevant government authority and has depended substantially on the financial support of a parent since before the age of 22.

Type C

The dependant is 22 years of age or older, has depended substantially on the financial support of a parent since before the age of 22, and is unable to provide for themselves because of a medical condition.
