Need assistance regarding job offer under the Express Entry Program.

Hi,
I've been working for Dollarama for over a year full-time and in September they promoted me to NOC A job with an offer letter. I am already on a Spousal Open Work Permit.
Is it considered an LMIA-exempt job offer?
Can I use this offer as a job offer under the Express Entry program to get the 200 scores?

No it is not a LMIA exempt job offer. You an open permit. Your employer needs to apply for LMIA exemption and only available for certain circumstances such as intercompany transfers, Free Trade agreements, post doctorate work.

Here it's written that if I work for more than 1 year full-time in a company and I have a valid job offer I have 2 of the conditions.

And for the 3rd condition, I've found this article:
Canadim - LMIA-Exempt Work Permits

Which says "Since open work permits are not restricted to an occupation or employer, they do not require an LMIA"

But I'm still not sure if it's accurate.

You are on an open permit. You don’t need a LMIA to work. LMIAs are closed work permits. You don’t have a job that is LMIA exempt unless the company is elgible and file for one (which a Dollarama is not eligible).

You need to meet all conditions. No mention of meeting 2 of 3 conditions.

Your employer doesn’t need an LMIA to support your job offer if:

1. you have been working full-time for the employer on your work permit for at least 1 year(or an equal amount of part-time work)
2. you have a valid job offer, and
3. you have a valid work permit that is exempt from an LMIA under:
   • an international agreement
   • a federal-provincial agreement
   • the “Canadian interests” category

The answers you have received are correct. You cannot claim points for having a job offer since you are on an open work permit with no employer named. This is a very well known rule.

Claiming points on an LMIA-exempt open work permit is only possible if it is a closed work permit with an employer named and after you have worked for that employer in Canada for a full year. Unfortunately you don't meet these conditions.
