can un-finished PhD degree be considered as master

I got my PhD directly from college without a master degree in the US. I am currently at my 2nd year of my PhD program in the US, and I have finished all the requirements for a master degree. Since I am not an American citizen or PR, I cannot master out my phd because I need to maintain my student status to stay in the US. Is there any possible way so that my Education level can be considered as Master. Thank you.

As far as I know you would have completed a condition for international student to go ahead with PhD. As you don't have coursework in PhD you can also complete it without going to Uni ( if it is not science or related subjects which require lab work). If no so consult your supervisor about continuing it from outside US. You can submit and can get chapters review online and can also conduct meetings via online as well.

Answering your question once you would try to get ECA or file your application it will require your completion certificate and transcript. If you have one then you are good.

No. Since no Master's degree has been awarded, you cannnot claim points for having a Master's. The Master's degree needs to be officially awarded in order for you to claim these points and this level of education.

A lot of students do end up getting a Master degree on the way to their PhDs while working as a graduate researcher in the US. You will have to talk to your school and the Master degree has to be conferred - A physical degree with transcripts issued while you look to continue your graduate research. A lot students and some of my as well friends have done that and it seems like a normal process particularly if your research allows you to take up courses that you had not covered earlier in your education.
Long story short - Talk to your School!

You need to talk to your department or grad school to figure out the policy. Some institutes, such as Columbia GSAS, allow PhD students who satisfy the requirements to get their MA degrees while they are still working towards their doctorates.
