I recently received my positive LMIA for NOC 4411 from my employer. I will be applying outside Canada (no experience in Canada). I’ve already informed my employers about the new Home Child Care Provider Pilot Program for applicants outside Canada, however they already applied and got me a positive LMIA which is under the Temporary Foreign Worker Program. Will IRCC consider my positive LMIA and issue a work permit even if I am outside Canada?

When did they apply for the LMIA? You are eligible if you meet the conditions in the link.

They got the lmia approved on Feb 3, 2022 and will expire on Nov 3, 2022. Do you think immigration will approve my work permit?

Eligibility
In most cases, you can apply for a work permit to work in Canada temporarily as a caregiver through the TFWP if one of these applies to you:

  1. You’re in Canada and eligible to apply for a work permit from inside Canada.
  2. You’re outside Canada and your employer applied for an LMIA before June 18, 2019.
  3. You’ll be working in Quebec.
You can’t apply for a new work permit (that needs an LMIA) in these cases:

  1. Your employer applied for an LMIA on or after June 18, 2019, and
    • you’re applying for a work permit from outside Canada through the TFWP and
    • you plan to work in a province or territory other than Quebec
  2. You apply for a work permit at a port of entry on or after April 22, 2022.
  3. You’re in Canada as a visitor and apply for your first work permit on or after April 22, 2022.

Thank so much for your inputs. I’ve mentioned this to my employers but they still pushed for the LMIA as they paid a huge amount in the application already. They had back and forth discussion with ESDC but then finally received the positive LMIA in Feb’22. I really hope IRCC will consider my work permit application.

Appreciate if there are other inputs from other members. Thank you.

Application fee is $1k. All you can do is apply and see what happens given you are outside Canada. Is this a family member? Where do you live? If you don't get a response by January 2023 then apply to the HCCP if it reopens in 2023. However processing is years it seems.

They’re not a family member. I will be applying from Dubai. Is it okay to have multiple applications, one for TFW and one for HCCP?

Make sure you have all documentation ready - ECA and IELTS.
Yes, I already have all the documents (ielts, eca, etc.) as I was planning to submit last January. However, there was no update from my employer back then so I was not able to push through with my HCCP application.

You will just waste your money and time. LMIA for outside applicants is already closed since june 18, 2019. Even visitors who are already in Canada cannot apply for a work permit (even with positive lmia) , it was announce in april 2022. before it was okay from visitors in canada to work permit (for caregivers), now no more.
If you're employer keeps on pushing you with this then better find a new employer. One applicant of January 2022 did the same thing, and got refused after 2 mons. All caregivers must go through hccp/hswp except in quebec

Hi, thanks for your input. I’ll wait for the update from IRCC and if see if needed to apply through hccp in Jan’23. The applicant you’ve mentioned, did she apply inside or outside Canada?

Let your employer know that you aren’t eligible so will apply for HCCP when it opens in January. Also let employer know that processing could be a long, long time.
