Hi All,

Sorry for the long passage, Thanks in advance.

I am in Canada on Closed Work Permit through my company in INDIA. I have applied Visitor Visa for my Wife and my Son on July 9th 2022. The status is Bio completed and last update was on July 29 as medicals updated. No updates after that.

I am bit nervous after seeing some of the posts in this forum that it will take some time to process my application for Visitor Visa for both my Wife and Son.


Here all are talking about Spousal Open Work Permit (SOWP) which is faster to get and she can work here in Canada ?

Could you please tell me can I apply now for them through SOWP or I can wait for Visitor Visa to get processed for both and then I can apply for SOWP.

Please confirm.

The visitor visa allows your wife and son to enter Canada. When they arrive, they can get work and study permits at the airport depending on certain factors. I am not 100% sure how it works for closed work permits, but I think that if your job is a NOC 0, a, or B, she'll be eligible for an open work permit. I'm also almost 100% sure that your son will get study permit regardless of your NOC. She can enter as a visitor only, but she won't be able to work.

I have one more question. Is that possible that if my wife is entering Canada in Visitor Visa. Can I apply and change it to a open work permit ?... If yes, let me know how to do that .

Also I came to know that in Canada dependents (wife) can work.

Please clarify.

Yes, your wife can apply for an open work permit from within Canada.

She must wait until the open work permit is approved before she starts working.
 
Thanks for your kind response. How we can apply the same. Can I apply after she landed here in Canada or do I have to wait for 2-3 months.

Also share me the portal link to apply for the same.

Not sure but have you heard of Google.com. It helps in searching a few things when people have given you a direction on what to look for.

It may help your wife to find jobs as well once she gets work permit.

yes, I do agree that if people giving the direction to look for and I am getting all I want in their reply, then I will go ahead and proceed further.
As I have some open questions like Portal link ... which I asked them to share, if they are interested to share they can share ... if not I can wait for others to answer.

Moreover I am not asking you directly to share the link, if you are interested to share, please share else ... why you are replying here with the Thought that you only knows everything ,... Grow up and be mature....

Please think twice before replying others who are in need of some information.

@cansha actually provided you with the link (CIC.ca) in her email. Did you click on the link and follow the instructions to get the required documentation?

How old is your child? If 4 or over and they are planning on relocating to Canada you need to apply for a study permit for your child. If you wife plans on living in Canada she should have applied for an SOWP not a TRV. TRV is really for visitors not someone wanting to remain in Canada longterm.

Your wife should really be applying for an SOWP because she isn’t a visitor. Hot or miss whether the VO approves the TRV or requires your wife to apply for an SOWP. If your wife’sTRav isn’t approved she’ll needto apply for an SOWP from her home country. If she receives TRV she can apply for an SOWP from Canada.

1. Visitor Visa mandate is that you are not allowed to work on a TRV, so no, she cannot work on VV.
2. SOWP is the only way for her to work, if she gets her TRV approved, apply for SOWP once she's here.
3. Visitor Visa also requires you to prove 'strong ties' to the home country, where you'll return. In your case, you, the spouse, is the strongest tie, and your 9 month old baby, will also be a significant tie, which is also mentioned in your application for TRV. Slim chances of them getting the TRV, but goodluck.
4. Be humble, and respectful. Once you receive a direction, work for finding the answer.
5. Yes the forums are for help, but no one would be willing to help with the attitude you're carrying.
