Hi All,

I have a spouse sponsorship application underway at CIC since November 2019; I have heard no response for a year since my response to a PFL stating that the Common-Law partnership was not a full 12 months before submitting the application.

I am wondering if it is possible to submit another application at the same time, or do I have to withdraw and submit again?

You have to withdraw first.

IMO - there is no point doing that. OP needs to withdraw the original application and reapply. Per an earlier post from the OP, they applied for common law when they only had 11 months of continuous cohabitation by mistake. So they didn't qualify as common law at the time the application was received by IRCC which means it's going to result in refusal.

Thanks - hadn't seen those other exchanges. If that's the case, gcms notes/MP will just confirm what's already known, so agree with you.

(GCMS/MP should likeliy have been ordered ages ago but moot now)

It can a while to get a response to a PFL, especially now. Basically the PFL means your application is no longer following the standard process and there are additional reviews, etc. PFLs generally always add months to processing times - even more now.

IMO - I would have withdraw your first application as soon as you received the PFL and realized that you don't have a full 12 months of continuous cohabitation.

It happens. I'm sure that internally, writing a refusal takes some work and extra authorizations/sign-offs.

Did you order gcms notes as you'd planned in December?

Side note, you could still inquire of your MP what's happening with your file. Downside is that it migth result in refusal (probably will if the facts are as @scylla stated). Upside is that there is a chance - small - that they might approve anyway - assuming that your PFL response outlined that you were still living together. (Note, I'm not going to argue that this decision would be 'correct' - just that it's not impossible).

Now, careful - I do not know if refusal would impact your current status in Canada, as I understand it's an inland app. Or indeed whether withdrawing and re-applying would.

It still would be prudent to assume the worst and start preparing your app now. And I do agree overall that you likely should have just withdrawn and re-applied.

Currently preparing my new application, as we speak!

I really don't understand why your lawyer recommended to keep the original application running. You have to meet the requirements at the time the application is received by IRCC. You weren't common law at the time the application was receive so that means the application should fail.

Anyway, it is what it is. I would withdraw asap and then submit a new one.

I was in a state of panic at the time and listened exactly to what they said; I didn't really question it!

It is too late now unfortunately but at least I have a new way forward. Thank you.

Sorry! Just a quick question, when withdrawing the application shall I mention anything in particular? Or just because of the PFL? Thank you.

I assume it's your own OWP, in which case, I don't see any harm in inquiring through MP - even if unliekly to change anything - but I repeat I don't have enough knowledge to say if refusal could impact your current status.
