Common Law ? How does it work ?

Hello guys, me and my boyfriend have lived with each other for a year plus now. It’s my place so his name isn’t on the lease or anything but he sends me money to pay for the bills. He is also a Canadian citizen, I’m on an open work visa . Is it possible to apply for common law since we live together ?

If you guys live together, why does he send you money to pay the bills ?

One easy way to prove the common-law relationship is to have a mutual bank account, or for you to name each other as beneficiary in a life insurance.

You need evidence to prove one year of continuous cohabitation if you want your boyfriend to sponsor you for PR under common law. This means you need to provide several pieces of evidence that date back a year to show you have been living together continuously for this time. It sounds like you don't have a joint lease. Do you have joint bank accounts or credit cards? Is his name on the utilities? Has he updated his address to use your joint address as his primary address (e.g. with his employer and/or school, his bank, CRA, etc.).

If all you have is evidence that he has been sending you money to pay the bills, that won't be enough. You need more than that and you need strong evidence that goes back a full year from the time you submit the application.

I have provided joint car insurance, car lease, both of our names were on the bills, we have also joint saving account, mobile phone bills were both on my name, her mobile and mine. We had a same address on our driving licences, her work contract had the same address as mine and electricity bills had both of our names etc. etc. so I have included all that and eligibility got passed without any issues.
