No child here in Canada, but have back home. it's been almost four years of being here now and appeal dismissed this week after 5months.What other options aside child interest? Possible to have a child with a lady as soon as possible?

Best interest of a child usually only applies to children already in Canada and isn’t a guaranteed reason for approval. At this point it would be very suspicious if you got someone pregnant right after your appeal was dismissed. Assume there is a good chance that you are from West Africa. What was your reason for seeking asylum? You’ll need to wait a year before applying for H&C.

So what other options can a judge consider?

There are a number of reasons. Things like establishment in Canada, providing benefit to Canada like working as a nurse for example, not depending on the government, etc. If you are receiving welfare it is very important that you get off of welfare and work so you have a long history of being financially self-sufficient. Approval is often based your overall profile not one single factor. It is harder as a younger single person who has spent the majority of their lives in their home country so have a strong connection to their home country.

In the events of a failed JR, what option is left?

Your assertion here is NOT CORRECT. Best interest of a child does not matter whether the child or children are Canadian or not. It does not also matter whether the kids live with you in canada or they live outside canada as long as they are your friends, you are good to go with best interest of child.

Also, it doesn’t matter whether you get married now and or you have a baby now or later. As long as you are failed refugee claimant and you are getting married, they suspect “marriage of convenience but there is nothing they can do about it as long as you have not violated any law. Your file will be treated.

Let’s guide ourselves accordingly and if we do not know or understand a situation, it’s better we don’t communicate rather than raise the tension or mislead ourselves.
