Hello all !
I applied for my wife on october 2016, should getting close to the end. I have a couple of questions
1-it says in the status of the application that they are processing the background check, what steps up coming?
2-we need to travel abroad as soon as possible for family issue, how long we would be able to make it after receiving the eligibility approval? what need to be done after getting the approval?

How long CIC takes to finalize everything after eligibility approval (AIP) varies for each applicant. I think it depends on the nature of your application, the assessing officer and the local IRCC. Thus, no one can guarantee how long your spousal application processing will last. Currently, CIC is processing applications received before September 15, 2016. Even after a decision is made, it could take weeks to get interview appointment depending on your location. Then, it will take couple of months to receive your PR card.

The question is, does your wife has a work permit and re-entry visa (TRV)/ ETA? If so then you can travel for family emergencies without any problem. However, this is not 100% guaranteed. But as far as you have the right documents, you shouldn't encounter any problem at the airport. I have my application pending ad I have left Canada twice for work related trips without problem of re-entry. I hold a valid work permit and TRV.

If your wife was out of status before you apply, then she better wait to receive PR card before leaving Canada.

Congrats on your SA approval. This was sent your sponsor's email? Did you check on ECAS and MyCIC if something has changed over there? As Sylvain said, pls remove your personal information. Looks like good news are coming.

Thank you for responding, further informations:

My wife came to Canada with multiple entry visitor visa, we applied for PR once in Canada, few months later she received a OWP (Open work permit to permit her stay over the initial six months)

If your wife has a valid open work permit and corresponding multiple entry visa (verify from IRCC if she needs a new TRV to state that she is a worker, not a visitor), then she is good to go. But to avoid staying LONGER!

Now, a month later they sent me a letter saying my records shows that i have been charged and convicted with "causing a bodily injured to any other person in violating of the special law traffic accident agreement" please provide copies of courts etc..but the thing is i have never once driven a car but i do have my driven license but i have never drove a car. After, i did my driving test and got my license i have never drove or have my owned car. So what the hell is going on????? has anyone been in a similar situation???? they have my police checks and it shows clear since i have never done anything wrong or an offence.

Do you have an Open Work Permit or you had a work permit before you started the sponsorship process ?

I cannot say I have heard of this specifically. But @meaningful1 was accused of being a police officer (or a member of the military -- I cannot remember) in Afghanistan. He's from Jamaica, not Afghanistan. So, as I recommended to him, I will recommend the same to you:

Write CIC a letter. Explain that you may possess a license, but you have never driven a vehicle. Therefore, it is impossible that you have had any conviction.

They will double check. If it is in fact an error, they will move on from that point. If it is not, they will advise you.

In Canada, if you are involved in traffic accident where a police physically comes in, there will be a court proceedings. If you choose not to attend, you will be charged and convicted if found guilty.

Now, if you are very sure that you have never been involved in any traffic accident before, then there might be a mistake from IRCC or from the RMCP (Canada Police Record Check). These are the options you may have:
- Order for GCMS notes asap (https://atip-aiprp.apps.gc.ca/atip/welcome.do). This will give you more details about what's going on and where the officer got this information from.
- Phone IRCC call center on 1-888-242-2100, but in most cases they are not helpful, especially if this case is actually on your file.
- If this happened in Canada, then you can visit your local RCMP to request for criminal record check and ask if you have any pending charge and convictions against you. You may also visit your Province driver's licensing and vehicle registration to inquire more. Normally, traffic incidents are reported to them.

If all these prove that you have no such history and your GCMS notes show that the officer has entered such case against you and efforts to get the IRCC call center resolve failed, then you can contact your local MP to help you out. You might need to provide proof that this was a mistake.

However, if such case exists and you confirmed with your Province/country, and you think it was a mistake, then you will have to resolve this with them and ask for letters of clarification to be sent to IRCC by yourself.

You lost me here. Can you confirm this?

Also, I have never heard of anything being described in Canadian traffic law as the OP described it. I think it's information that was sourced from a foreign government that needs to be verified. They will not verify it, until the issue is brought to their attention -- as I suggested, a letter is the best way to get the government to move on something.

I am equally thinking that this might have occurred in another country. But what I mean is, in Canada, if you choose not to appear in court for traffic incident case, the case still proceeds. And if found guilty a charge and conviction is entered against you. Is that where you wanted clarification?
