Hi to all,
I am here in Canada with my daughter. She feels lonely even though she has friends. She has her niece she grew up with and they are same age.

My Question, which is the way i can bring her to Canada so my daughter can have company? Adoption or sponsorship? The child is 11 years old.

Please i need advice on this important issue.

Is the niece an orphan (ie. Both parents deceased)? Under the circumstances that you describe, an adoption for the purpose of gaining immigration status, may be seen by CIC as an Adoption of Convenience.

Agreed. If the niece is an orphan then you have a chance. Otherwise - no. The only option would be to bring her temporarily to Canada on a study permit (note that public school tuition for foreign students is around $13K per year).

That's oddly bizarre. I would have thought that once through the "legal" process of "adoption", that child is truly your dependent and your obligation. I don't see how they could refuse.

Because they may say it's an adoption of convenience to facilitate immigration.

• the best interests of the child in question;
• it must create a genuine parent-child relationship that permanently severs the legal ties to the child's biological parents;
• it must be carried out in accordance with the laws of the place where the adoption took place and the laws of the country of residence where the adoptive parents resided at the time of the adoption; and
it must not have been entered into primarily for the purpose of acquiring a status or privilege in relation to immigration or citizenship (i.e. an adoption of convenience).

Scylla is absolutely correct. I have reviewed many cases on canlii where appeals were lost due to adoption of convenience (just like marriage of convenience). And unfortunately the OPs reasoning (ie his child being lonely) is not a good reason for CIC to adopt and sponsor.

Usually one would only adopt a child if the child is orphaned. If the child's parents are still alive and the child is not in any immediate danger or something, then there is no real need for adoption other than for immigration purposes.
