Temporary Work Permits for CPTPP Intra-Corporate Transferees

The Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) allows eligible employees of foreign businesses with a Canadian parent company, branch, subsidiary, or affiliate to enter Canada for up to three years (with possible extensions) without a Labour Market Impact Assessment (LMIA).

Eligibility Criteria for CPTPP Intra-Corporate Transferees

All intra-corporate transferees must meet these conditions:

  • Be a citizen of a CPTPP signatory
  • Have been employed by an enterprise of or have been partners in an enterprise of a CPTPP signatory continuously for at least one (1) year within the previous three (3)  years at the time of applying.
    • Includes citizens of CPTPP countries who are employed by an enterprise in another CPTPP signatory.
  • Be transferred to an enterprise that must be a parent company, branch, subsidiary, or affiliate of a company in Canada.

The Government of Canada may require proof that the employee has been employed continuously by the enterprise for one year within the three-year period immediately preceding the date of the application for admission.

Employees admitted to Canada under the Intra-Corporate Transferee category receive a work permit that is valid for up to three years, and extensions are possible.

The business person must be doing work as one of the following:

  • executive;
  • manager;
  • specialist; or
  • management trainee on professional development.

Executive is defined as a business person within an organization who directs the organization or a major component or function of the organization, establishes the organization’s goals and policies, and receives only general direction from higher-level executives, the board of directors or shareholders.

Manager is considered a business person who primarily directs the organization or a department within the organization, supervises and controls the work other supervisory, professional or managerial employees, has the authority to hire and fire and exercises discretionary authority over day-to-day operations.

Specialist is defined as employees possessing specialized knowledge of a company’s products, services, processes or procedures and their application in international markets.

Management Trainee on Professional Development is an employee with a post-secondary degree who has been sent to the Canadian parent, branch subsidiary or affiliate to broaden their knowledge and experience in preparation for a senior leadership position within the company.

The applicant must belong to one of the following categories (as defined above), which are only available to citizens of Australia, Japan, Mexico and New Zealand:

  • Executives
  • Specialists
  • Managers
