WP sent 3 weeks before expiry-STATUS?

The new regulation has made a lot of impact to WP holders in a way that the it necesitates an early submittal fo WP extension12 weeks before expiry.

If you are applying for a work permit for a job that requires a Labour Market Opinion (LMO), you must now include the valid LMO with your application.

We are no longer accepting work permit applications without valid LMOs.


What about the case where an WP application with an approved LMO is submitted say 2-3 weeks before the WP expires, will the applicant stop working the day after the WP expires (even if its for the same employer). and wait till the new application is approved. Does the applicant need to apply for restoration of status while waiting for the WP?

Can any of the senior moderator clear this up?

This means that an applicant who submits a WP extension with an approved LMO before the WP expires, will be on implied status while waiting for the decision after the previous WP expires.

Yup, if you have submitted an application for a WP with the LMO for the same employer before the expiration of your current WP, you'd be on implied status.

Great, then Implied Status is still there, all along my understanding was that Implied status is gone from the last CIC bulletin.

All is clear now.

Implied status is gone for those that apply for a work permit without including a new LMO>

hi PMM,

my husband's provincial nomination has already been approved, PR application in process. since his work permit is about to expire nov.30 he applied for extension but he did not attach an LMO. if we don't receive the PR visa by nov.30, would he be on implied status after that date? and would he still be allowed to work?

If you have a provincial nomination a LMO is not needed to apply for a TWP extension. he will be on "implied Status" until the decision is made. I went through this in 2010, my TWP expired in early August and I applied for an extension in June but the new permit did not arrive until September. You should have received a letter from the provincial nominee program to include with a TWP extension application.

thanks! i know we should have sent the application for extension sooner. we talked to an immigration lawyer after being nominated and we were told processing of PR visa at CIC will only take 6-8 months. we should not have taken her word because 6 and 8 months have passed and we still dont have approval of our PR application. we are waiting for our passport to be requested. how many days is implied status, is it 90 days?

Probably not the lawyer's fault. Processing times change all the time. Looking at your timeline, processing time she gave you WAS correct. But now the backlog is bigger so it's taking longer.

Implied status lasts until your husband receives a decision on the extension request.

of course :) out of our eagerness to be PR's and also we didn't know that processing times change all the time, we did not think of submitting the extension of WP right away. anyway, thanks for your reply.

I think you have implied status until they either send you the new permit or notify you of a refusal.
