Hi,

just got the news today that my WP is refused. i still have a valid LMO. talked to CIC but they told i have to leave the country and apply fresh from my home country against the LMO. The WP was rejected on the ground of out of status. Previous WP expired in month of Jan

the problem is my wife is 7+ months pregnant and can not travel back. having a positive LMO is there a possibility to re-open the file or get WP approved on some other basis. as i will no longer be on valid status, i will not get OHIP cover.

can any one help me with a way to get WP approved from within Canada.

any kind of help is appreciated.
 
Sorry to hear about the predicament you face. What grounds did they give you for refusal of WP?

Apply for new work permit on basis of your LMO, I am not sure as you didn't mentioned when your previous work expired, but you can apply for restoration and work permit together, no need to leave country.!
 
Did you apply for restoration of status and new work permit within 90 days of your work permit expiring? If you did not do it by April, you have no status and it's probably the reason for refusal.

Consult a lawyer asap. Your wife may still be able to travel but not for much longer, so you should act fast. If you have to go home and decide to leave her here, you should make adequate arrangements and leave sufficient money to cover her expenses. As a temporary resident, she may not qualify for certain programs available to expectant mothers who are Canadians and PRs. Also, child birth without insurance could be as high as $10,000 or more if there is complications.
