WP Extension Rejected.

Hello,

I came to Canada on a Work Permit valid for 6 months and subsequently applied for Work Permit Extension.
I just received a letter from CIC that my WP Extension Application is rejected as my employer has not obtained a LMO.

The attorney processing the application writes that,

"You currently do not have any status in Canada (as of xyz date) and if you are in Canada, you must stop work immediately.

If you do not intend to apply to restore your temporary resident status (apply for restoration) and to include a work permit application with an LMO to support it, you must leave Canada immediately"

However, The CIC letter states that "You may apply for restoration within 90 days ...."

The above sounds confusing and contradictory.

1. If I do file for restoration by submitting the necessary documentation, can I continue to work in Canada till the "Restoration Application" is processed?
2. Can I continue to work in Canada, till the time I submit the documentation for "Restoration"?
3. What exactly is restoration?
4. How soon can you expect to get a response (accept or reject) on the "Restoration"?
5. What are the chances the "Restoration" is successful?

Any help in this regards is much appreciated.

Hi

1. You can continue to work till the last date of your original 6 month work permit only.
2. A response on your application takes 1-2 months time.
3. If LMO and other documents are in order restoration is almost certain.

you can work if you submit an application for restoration and new WP

I'm no sure but I'd say no. You can certainly submit this application online in a single night and as soon as you do so you"ll be okay to work.

3. What exactly is restoration?
It is the process through which hose who lost their status can go. Within 90 days from the date you lost status and even though you are illegal, Canada allows you to restore your status and become legal again.
As i said you got 90days from the day u lost status to apply. You also need to apply for both Restoration ($200) and WP ($150).

4. How soon can you expect to get a response (accept or reject) on the "Restoration"?
You'll get the response along wih WP decision. Your employer needs first to apply for LMO and then you can either mail or do online application for boh restoration & WP.

5. What are the chances the "Restoration" is successful?
I don't know really but i think you don't have much choices... because if you dont do it and pass 90 days, they might send you a letter for deportation... and it gets serious then. So, my advice go online and apply for Restoration and WP altogether. Do tht as soon as your boss get LMO approved.

Now, you may want to opt to mail application if your employer agrees and send forms for LMO. If so, you won't need to have LMO approved right away. so as a step :
1) ask your boss to do LMO (He can fax, apply online, or mail)
2) when he agrees to it and does it, then mail your application for Restoration & WP. Note: you will need to write that LMO will be provided later and the date and confirmation it was sent and received by HRSDC.
3) resume work for him/her till you get decision from Vegreville.
4) when Lmo will be approved call CIC hotline to provide them the Ref# (starts with 7)

Some BAD advice on here.

1. NO. You must stop working immediately.
2. NO. Same as above.
3. When a permit expires, if the person remains in Canada they have NO immigration status. Restoration is where an applicant applies to have CIC consider giving the applicant their immigration status back or change to another status (i.e. worker to visitor). It's a last chance to convince them that you should be allowed to remain in Canada as a visitor, worker, student.
4. It depends on your method of application. Online is faster than a paper application.
5. Again, it depends on the reasons for refusal and what you can show them to overcome those reasons or convince them to change your status.

hello when is ur work permit expire? if your permit expired, you are not allowed to work. only if you are in implied status.
