I am from the United States. I am a visiting my wife in Alberta and want to stay with her until my permanent resident application gets approved. I just submitted my application last week for permanent resident status as an out land application although I would like to stay with her until they finish my application which is estimated to take 16 months. I was issued a visitor record a few weeks ago which is good for 6 months when I came back into Canada after vacationing with my wife.

I want to see if there are any work visa applications that would allow me to work in Canada while I wait for my pr application to get processed. My work experience is related to corporate budgeting/accounting work. I also owned and operated a small business so I have business management experience as well. I have a bachelors degree in business.

Is there any kind of work permit that makes sense that I can apply for someone in my type of situation?

To qualify for a work permit you would first need to find an employer in Canada who is willing to offer you a full time job. That employer would then need to obtain an approved Labour Market Opinion (unless your job qualifies under NAFTA in which case you can skip this step). You then qualify for a close work permit tied to that specific employer.

Unfortunately applying for spousal PR outland doesn't give you special access to any work permit. You have to follow the same process as anyone else to qualify.

Hi Jay, if you apply for outland, you are not legally allowed to work in Canada during the application process, as you have been admitted as ONLY a visitor. Visitors can not work or study while in the country. In order to get a work permit, as the above poster mentions you need to first have a job offer, then the employer needs to apply for a Labor Market Opinion to prove they need a foriegn worker to do the job. From what I've read on here, the wait times for those are creeping up to more than 5 months!

In regards to the 16 month process, i am not sure that is accurate. On the family sponsorship board, you will see threads about application months and processing times. Even though the CIC website says a certain # of months, it is not accurate. Also, if you found the 16 mo. you reference because you were looking at a US based visa office, it is not guaranteed your application will be transferred to the US office. According to the informaiton on these threads, applications are sent to the US offices if they are suspicious on the intent of the applicant (ie: marriage fraud, misrepresentation, etc.). US/Canadian applications generally stay in Canada. I am not sure if they all go to Ottawa. Right now ottawa has a wait time of about 8-10 months for approval. A lot quicker than stated online! From what I have read US/Canadian applications get some leeway since we are not considered to be an at risk country. Apparently, a lot of interviews are also waived.

If you were referring to an inland application timeframe - that's a whole different story, and it doesn't seem to be recommended as it can take significantly longer.
