I have been on an Intra-company transferee (ICT) work permit, and my work permit reads, "MUST LEAVE CANADA BY 2022/10/07" because of the five-year max. cap.
However, I have a "Recaptured time" of three months that could be utilized. Considering that, I assume I must leave by 2023/01/07 (i.e., three months after work permit's exit date).
My employer wants to file a work permit extension application on 2022/10/06 (i.e., one day before the work permit's exit date) for me, for three months of recaptured time. It takes about five months for the results of the application to come. Hence, in the best of situation, my application results would come only by March, 2023, and not before that. In that case, my primary question is: Will my status be legal in Canada after 2023/01/07?
My employer thinks that if positive results come by March, 2023, my new work permit will allow me to work for three months more, starting from March, 2023, until June, 2023. So, just to let me buy more time, they say it would be best to file extension application on 2022/10/06, i.e., one day before the work permit's exit date.
In this regard, my secondary question is: Is my employer's understanding correct?
