Work Permit with my Husband's Study Permit

Hello ALL


I have lot of questions. Please Help me.

I am working in an IT company as a software tester with my post graduate work permit. I have my Work permit valid till July 29th 2017. I am planning to apply for PR later to July in CEC Class. So that i will have one year work experience in Canada.

I am married and my husband is back in India. Now, he is planning to come to study in Canada this January 2017.

My questions are,

1. If i apply PR after July i will have to get back to India as i will not have any status here. Can i use my husband's study permit and apply for a work permit??
2. If yes, When should i start this process??
3. Is it acceptable??
4. What else can i do to stay here after july??
5. Is there any other best option??

Please help me. We do not want to take hasty decision and be separated again. Only reason he is coming here to study is we both are missing each other. If i get to go back to India in July then there is no point in him coming here to study investing lump some money.

Hi,

When your husband applies for Study permit, you will get a 3 years open work permit, but the study should be full time for 2 years or greater atleast.

I do not understand.

I am already in Canada working with Post Graduate work permit. Do you mean if he applies for 2 years Study i will immediately get 3 Years work permit??

Yes whilst applying for his study permit, apply for spouse open work permit, in this case he will get 2/3 years study permit (he can only work for 20 hours a week with his study permit) and you will get 2/3 years open permit.

Hi, it doesn't have to be a 2/3 years study period. You can get a Spousal Open Work Permit with even a 12 month study permit (the minimum required). And after your husband gets his PGWP, you will be eligible for an SOWP again.

Note that a PGWP holder must already be working in a NOC A, B or 0 job for the spouse to qualify for an SOWP.
