Hello,

I'm a web developer, currently resident in Montreal and I'd like to ask about work permit transferring.
My current work permit with company A is still available until February 2016.
However, now I want to work for another company (B), do I need to apply a new work permit with B or my current work permit can be transferred?
What documents do I have to apply work permit and begin working with B?

Additional details:
- When I get work permit with company A, my wife gets a spousal work permit and has been working with a company (C) in pharmaceutical area as Quality Assurance .
Now I stopped working with company A, can I get a spousal work permit because of my wife ?
What can I do in my situation so that I can begin working with B.

Annotation:
- A: company where I worked from 2013-2014
- B: company where I want to work for
- C: my wife's company

Has anybody here went through this process before, please share some experience with me
Many thanks,

scylla

How did you get your current work permit? Did your employer obtain an LMO/LMIA and then you applied for a work permit based on this approval? If so, then you cannot switch employers on your current work permit. To change employers, your new employer needs to first obtain an approved LMIA. Once your new employer has an approved LMIA, you will then be able to apply for a new work permit. Once the new work permit is approved and issed, you will be able to start working for your new company. You cannot start working until you have the new work permit.

No - you cannot get a spousal work permit based on your wife's role. You can't get a SOWP based on your wife's SOWP. If you wanted to get a SOWP based on her job, she would first have to find an employer willing to offer her a full time NOC A, B or 0 job, then that employer would need to obtain an approved LMIA, then she would need to apply for a closed work permit based on that LMIA - once her work permit is approved and she starts working for her new employer you would then be able to apply for a SOWP (since your wife would not longer be on a SOWP).
