Hello Everyone,

I want to apply for PR, my situation is that I am employed at our Canadian Branch of our Singapore based company who has branches in Europe, Asia, and North America including Canada. I have been holding high skilled work permit with a validity of 2 years work permit (til june '13)

Even though I have not traveled to Canada yet (because my company assigned me different projects in Europe etc) and I was also involved with the Canadian branch with various projects which resulted in profitable businesses -

I want to know can I apply for PR under CEC, considering I have been holding work permit for almost 2 years?

Please advise your thoughts as to what would be the best path for permanent resident application. thanks

You say you've been employed at the Canadian branch of your Singapore-based company but at the same time, you haven't travelled to Canada. How can this be? In what country are you actually working?

@newhere78 - if you have not traveled to Canada, then what you actually hold is an approval of your work permit but not the work permit itself. Work Permit will be approved at the Canadian Embassy to where you legally reside but then the actual permit will be given on your arrival at the Canadian POE Immigration Office.

Hello,

Thanks for your email -
I have been issued sticker in my passport with 2 years validity - its says Catergory WORKER. it was issued here in Singapore by the Canadian embassy.

The reason I didnt yet travel to Canada was that my company assigned me different projects in Europe which are related to the work in Canada, which now resulted in good profits. So I was remotely controlling the canadian branch, I have all papers to prove that.

My question is that what option should I apply for PR based on this, CEC or FSW, since I already have permanent job in Canada.

Please advise.

CEC is definitely out. To qualify for CEC, you must have physically worked in Canada for at least one full year. So you don't qualify for this immigration stream.

I already have a highly skilled permanent job in Canada, so what would be the option for me to apply for PR.
could you kindly send me some links to read more about it and where to download forms - thanks for your help.

As others have said, since you've never worked in Canada, you don't qualify for CEC.

You may qualify for FSWP but you'll have to check the eligibility criteria. If you can get an AEO, you could apply now; if not, you'll have to wait till May 4th.

AEO is Arranged Employment Opinion from HRSDC (please check this link: http://www.hrsdc.gc.ca/eng/workplaceskills/foreign_workers/aehrdcassess.shtml)

What is with May 4th, are new laws coming up, you think they are relaxed for senior executives with highly paid job offers, could you kindly shed some light on it. thanks

Right now, the FSWP is closed to new applications except if you have an AEO or are in a PhD program in Canada. The program will re-open on May 4th with new and revised criteria.

The new rules will be relaxed in the sense that from May 4th any occupation will be able to apply, but also tougher in regard to language proficiency, preference for younger applicants, and pre-arrival credential assessment.

If your employer wants you to work permanently in Canada (not a job overseas working on projects related to Canadian operations), then he/she can apply for an AEO (Arranged Employment Opinion) from Service Canada. If successful, you can use that AEO to apply to immigrate under the FSWP. You need to achieve 67 points to qualify under the FSWP's selection criteria and an AEO will give you 15 points toward the 67.
