Work Permit for Common Law of Student

Hi all

1. I'm on study permit in Canada right now (one year master program, valid to Sep 2014).
2. I DID NOT mentioned my GF in my file for study permit & marked my martial status as SINGLE.
3. Now she wants to accompany me in Canada.
4. She does not require visitor visa and can enter Canada w/o problem (up to 6 month stay).

The question is:

How can we get a work permit for her?

- being my common law , but we have no evidence at all for that (no rent lease, no joint bank account or bills) + she is not mentioned in my file.

She arrives to US in September and come to visit me for few weeks.

I see no chances to get OWP for her via applying as student's common law partner (not in my file + no evidences).

So, what are alternative ways?

Does marriage could help or it would be even more suspicious (applying day after wedding)?

So lying to CIC by declaring yourself single when you were actually in a common-law relationship was misrepresentation. You can be deported and banned from Canada for at least 2 years just for that. Have a look here http://www.cic.gc.ca/english/information/protection/fraud/document.asp

If you were to try to get her an OWP based on your common-law relationship, you would just be pointing out to CIC that you lied on your application.

She can enter as a visitor and extend her visitor status on her own. Or she can try to get a work or study permit on her own merits.

Getting married and applying right away is suspicious. And if CIC requests more proof of the relationship, they might see that you were already common-law and lied on your app.

Probably, I dismissed definition of common law, we were dating for 8-9 months so it's not a common law, sorry for misinformation.

My path for PR is:
1. applying under Ontario masters stream
and
for - PGWP

then, if provincial nominee granted

2. apply for PR


The question is, what would be the best way to get a PR for my GF?

1. marry her and apply for PNP together ? is it possible? not suspicious if marriage done six months before apply? could it lower my chances?
2. get PR >> marry >> sponsorship ? supposed to take too long

Ah. You need to be very careful about the terminology you use here, as it can greatly change the advice you receive.

CIC will look at the entirety of your relationship, not just after the marriage. If you can show lots of strong ongoing evidence from the start of the relationship, CIC won't really consider getting married suspicious. If you can't show any evidence from before the marriage, then they may see it as suspicious.

If you can show lots of proof, then getting married, living together for 6 months and applying together should be fine.

No one can answer that for you.

As I said, if you can show lots of strong proof throughout the entire relationship, CIC won't really consider getting married suspicious. You could get married and apply together.

If you don't have any proof of the relationship, then it is very possible that CIC might be suspicious of the marriage.
