Work Permit Extension

Hi everyone,

I have a unique situation, not sure if anyone encountered that but I would appreciate some advice.
My PGWPP expired in September and before it expired I had applied for extension. At that point I had Express entry profile created with 436 CRS score. Now, I called CIC to confirm the status of that application, they said it's not going to get approved since I had to put in PR application before my work permit expired and that is the only way they would have given me extension. As per them, I will have to wait for the rejection letter and they consider me on implied status until a decision is made on my application. In the meanwhile I was able to increase my CRS score and upon ITA applied for PR in Nov. My question is:
Do I need to apply for some sort of status now or I would still be counted under Implied/Applied?
Do I get 90 days restoration upon receiving the rejection letter or what will happen then?
Also, CIC agent told me that I need to get an application for extension of my status within my 90 days of my work permit expiry. Do I need to follow that or there is another way of doing it?

Right now you have implied status.

Since you applied for an extension when you did not qualify for one, IRCC is most likely going to return your application as incomplete (reject rather than refuse). If that happens, you will automatically go out of status in Canada effective the date your PGWP expired in September. This means the 90 day countdown for restoration will start from that date in September. It also means that any work experience gained after your PGWP expired will be classified as unauthorized work (i.e. illegal work) and cannot be counted towards any Canadian immigration program. If you used any work experience since your PGWP expired to boost your CRS score and be selected through EE - that may end up being a problem later and result in a refusal of your PR application.

Hey Scylla,

Thanks for the reply. I already have 2 years of Work experience and I have not used this implied period's work experience in my PR application. What should be my next steps in this scenario? So if I understand you correctly, once I get my rejection letter I would not get any restoration period. Is that correct? Also, my restoration of 90 days from September will end in December so regardless of my existing PR application, I would have to apply for Visitor/Study as my legal status to live in Canada after December?
