Hello,

I would like to present a situation to you all and would request expert advise:

- Let's say my work permit expires on September 30th, 2016. Can I apply for a work permit extension? If so, do I have to apply before or can I apply after the expiry? I understand the processing time is around 3 months and I will be on implied status meaning I can continue working and hope to receive an ITA in the near future. Now let's say I receive an ITA in November after I applied for work permit extension, can I submit a copy of my AOR to IRCC in order to solidify my case for extension?

Yes, you should apply for your WP extension before September 30, 2016.

- If so, do I have to apply before or can I apply after the expiry?
You should apply before your current WP expiry date.
After WP expiry, you can't apply from inside Canada.

If you filed your WP extension before your current WP expiry date, you can continue your work legally until the new WP extension decision made by IRCC.

As you don't qualify for a new work permit, your app may be rejected as incomplete. This means that you would not benefit from having been on Implied Status and any work done after your current work permit expires would be illegal.

You haven't stated any basis for being eligible for a new work permit. If you were eligible, it would be important to apply before the old permit expires, to benefit from "implied status" (authorization to continue working until you receive a response to your work permit renewal application). There is nothing to stop you from submitting an application.

However, if you apply for a work permit without submitting documentation to support your eligibility, one of 2 things will happen - your application will be returned as incomplete (no implied status; your status will have expired with your work permit), or your application will be processed (lose the application fee) and refused, and your status will expire with the refusal of the work permit application.

Well, you certainly can try. But at the time you apply for a BOWP, you are required to have a valid work permit (implied status does not meet the requirements).

What you are proposing was a strategy that used to work for some in the past. But IRCC has recently tightened up its rules on "implied status" to reduce this kind of "playing the system."

What others have said. This is no longer possible since CIC became fed up with people like you applying for extensions who didn't qualify. You won't end up with implied status and the work will be illegal since your status will expire along with your work permit. So no.
