Hi
Once my work permit expires and I want to stay in Canada a few more weeks to pack up etc, do I l have to leave the country and return on a visitors permit to stay a few weeks longer??

Hi anothertime, you can also apply online to get an extension as a visitor: http://www.cic.gc.ca/english/e-services/extend-visit.asp. Be careful though, you have to apply at least one month before the expiration date of your current permit. I am not sure if you can just go out and come in so easily... It may be better to do it while you are here...
 
Hi Sandra,

Usually CIC gives you 90 days to restore your status in Canada. So basically, they are telling you that you can stay in Canada for 90 after your permit expires, otherwise you have to leave.

It is possible to "restore status" if you allow your documents to expire, but it's more costly - much better to apply to extend your status and not let it expire in the first place...
 
I am on an implied status now, trying to restore my WP, i was on PGWP before, my company would not give me an LMO. It is very crucial for me at this point.

Should i apply to restore my status or just leave and wait.

Restoration of status cost about $200 plus a new WP $150.

Suggestion please

Hmmm.... can you clarify, how are you on implied status? You are only on implied status (allowed to continue working) if you apply for a new work permit BEFORE the old one expires (in that case, no need to "restore.").

If your work permit has already expired, you could apply to restore status and change to a VISITOR's Permit within the 90 day restoration period.

Without the LMO, tho, you won't be able to work. Only you know if you can manage to live in Canada without working, or if you should go "home" and wait.

1. Did you apply for extension(for the same employer) before PGWP expired?
a) If yes, you have implied status, can continue working and stay in Canada until CIC makes a decision. You will lose implied status if you leave Canada before the new permit is issued.

b) If no, you have to apply for restoration of status.

2. Did you apply for extension(with new employer) before PGWP expired?
a) If yes, you do not have implied status, must stop working when permit expires. Can start working again when new permit arrives and can stay in Canada until decision is made.

b) If no, you have to apply for restoration of status.

3. Temporary resident visa(TRV) - new work permit required before you can renew TRV

4. Changing status to visitor - only applicable if you are not able to restore your status to worker and want to remain in Canada legally. Note that visitors are not permitted to work.

Yes i applied to extend my PGWP with the same employer before it expires, i was thinking to restore my status and change it to visitor and trying to clean up my stuff and go back to my home country. because as you mentioned earlier, i can't get a new WP without LMO even if i restore my status. Please advice.

My PGWP is expired almost close to 90 days, i'm on an implied status now. Therefore i want to apply for a restoration of status before hte 90 days gone. Please help.

I see where you worry comes from. Contact the call center and ask them whether the 90 day restoration period begins from the expiry date of your work permit(eventhough you are still on implied status) or from the date your application is rejected?

I asked CIC officer, the 90 days count afte CIC make the decision on the WP extension.

Yes, good - that's what I was going to say. No need to apply for restoration until you get a decision on the WP.
