Hi, I submitted the common-law application in Oct 2011. I am still waiting for the news from immigration office. I would really need some help from you since I am currently working under my work permit which expires in Aug 5th 2012. I would expect at least one year for the immigration office to process the application. The problem is I am currently working and the Human Resource wont support me applying the work permit. I asked my immigration lawyer and he said I can apply to extend my current open work permit, but the immigration office will only renew my work permit in Oct 2012, which means that there will be a two months gap between my current work permit expire and the renewed work permit. I know that during this two months period, I should have a legal status and I am eligible to work. But Human Resource may kick me out of the company since my current work permit and SIN card expire on Aug 5th. And I need to wait until Oct to show Human Resource my new work permit.

I would like to know that if I can apply the extended work permit in either June or July while my current work permit expires in Aug 2012. So that I would have a continuous work permit paper and SIN card. I really want to keep this job. It took me long time to find a job like this one.

Please let me know if there is other way to avoid this problem. Thank you very much

Implied status and an expired SIN is not a valid reason for your employer to "kick you out". If you provide evidence to your employer that you are under implied status, the expired SIN can continue to be used.

Thank you very much for your help. I have question about the implied status. Since the government can not issue me a new SIN card due to the implied status, how would my company HR know when my implied status end? Is there a max time length for the implied status?

Thank you
