I'm in a wierd situation where I can't seem to find the right answer so I'm asking the pros here.
My post graduate work permit ends in two months (a year earlier) because of my passport expiration date.
I'm thinking of going back to Japan and coming back at the end of next month so I can be with my family during this crazy time.
I have applied for a new passport which I will be getting next week and apply for pgwp extension right away.
1. Some people have told me that if I leave Canada after applying for my extension, the application for that extension will be canceled? Is this true?
2. Since I will be coming back before my work permit expires, will I be able to continue working as "implied status?" while I'm waiting approval for the extension? or will I fall into a different category?
The IRCC FAQ has a very similar answer to my question but is very ambiguous as it does not tell whether a person came back to Canada before the expiration of work permit.
Q. "I HAVE APPLIED TO EXTEND MY WORK PERMIT. CAN I TRAVEL OUTSIDE CANADA?"
A.
1. You may be allowed to come back as a visitor if a decision has not been made. IF this is the case, you cannot work until you get your work permit extension.
2. You may be allowed to come back to Canada as a worker if the officer at the port finds your permit extension has been approved
3. you may be asked to apply at port of entry.
It looks pretty straight forward but my confusion is what if I comeback before my work permit has expired but applied for extension 2 months before the expiration?
ANOTHER section which is confusing is
Q. "I HAVE APPLIED FOR A NEW WORK PERMIT. CAN I STAY IN CANADA IF MY WORK PERMIT EXPIRES?"
A. Yes and you may be able to keep working as "implied status." However you must respect the following requirement:
If you applied for another work permit
- You must stay in Canada and meet the conditions of your original work permit. IF you applied for a work permit extension before your work permit expired, you can keep working under the same conditions as your exisiting permit until we decide on your application.
does the section part of the answer mean that I have to stay in Canada when I applied for an extension?
