Work Permit Concerns_Please Help

Hello everyone,

I would like to seek your advice on my situation.

In mid-February, my wife and I submitted study permit and SOWP extension applications, respectively. Our initial permits expired at the end of April. Up until now, we have not received any decision on the applications. In January, I received an ITA to apply for permanent residency under CEC, and I submitted my PR application by the end of February. As my SOWP extension application was still pending, I refrained from applying for the BOWP immediately. According to the SOWP letter, I am allowed to continue working until mid-June or until a decision is made.

Due to the prolonged processing time for the extension, I decided to apply for the BOWP in April. The letter for the BOWP states that I can continue working until mid-August or until a decision is made. Unfortunately, my wife's study permit extension has not shown any progress, and she has been unable to apply for a PGWP as her study permit is currently invalid.

These circumstances have heightened our concerns about our present status. So far, I have been maintaining implied status under both the SOWP and BOWP permits. My wife is also on implied status.

I have a few questions, and I hope you can provide me with some guidance:

  • If the date indicated on the BOWP letter arrives and there is still no decision on my BOWP, am I still permitted to continue working?
  • If my BOWP application is not approved, what alternatives are available for me to maintain my status and continue working?
  • In the event that my PR application is not approved before a decision is made on my BOWP, I understand that my BOWP will also be rejected. However, are there any steps I can take to preserve my status and avoid losing my job?
  • If the BOWP option does not work out, is it possible for me to apply for a work permit under my wife's name as a dependent? If this is feasible, what specific actions should we take given the difficulties she is facing with her own application?

In general, you can't work without work permit.
If your spouse lose her status or in implied status, then your SOPW is invalid.
If you have BOWP, then your SOPW is invalid/expired. You only have one status in Canada, no more than one. You can apply to restore your status during processing time of your PR application.
When you apply PR, did you fill your spouse name in your application as well?
If your wife has no status in Canada, she should restore her status first, (maybe apply visitor visa) extended her stay in Canada, then check you both conditions to be continued maintain your and your wife status in Canada.
