Work permit application, No LMO

So I'm Australian in Canada on a WHP which expires in October. I have sent off my PNP application but am not expecting an answer back for another 4months or so. I have been advised by a lawyer that since my WHP expires soon that I should send off a Work Permit application so that I can have implied status and continue working in Canada. The only thing is that being on a WHP my employer didn't need an LMO and now we don't have enough time to get a LMO before my current WHP expires. Other posts on this forum have some useful imformation about sending off the work permit application without an LMO, but the Immagration canada website specifically states that they don't acept work permit applications without an LMO. I guess what I'm really trying to find out is, If I sennd of my work permit application will they immediatly reject it due to not having a LMO yet, or can I send it off then send or phone them with my LMO information at a later date? Thanks.

You have been misinformed...You can not work while holding an "Implied status"

@milsy, yes you can still send your application for a new work permit even if the LMO is still on process for as long as you'll be working with same employer. Same thing happened to me, last June 21 was the expiration of my old permit and I haven't received my LMO until the first week of July. I called the immgration before June 21, and asked them what to do, and they said i can send my application for new work permit while waiting for my new LMO,(you need your new contract, and copy of passport) and i have to send my application before the 21st of June so that i can have an implied status....once you get your LMO, then you can just call the immgration and give them the reference number of your new LMO..better if you'll send your application online..I received already my new permit first week of sept...

If your temporary resident status (e.g., as a worker, student or visitor) is about to expire, you should ensure that your application to extend your status is received by CIC before your status expires as shown on your immigration document. If you do this, your period of authorized stay as a temporary resident will be extended by law until a decision is made and you are notified. In this case, you are considered to have implied status as a temporary resident during that time, as long as you stay in Canada.

Note: “Implied status” only applies if your conditions do not change. For example, if you apply to renew your study permit and the permit expires before you receive an answer, you can continue to study in Canada until you receive a decision. If you hold a work permit, you may continue working under the same conditions as your previous work permit while on implied status if you have applied to extend your stay in Canada as a worker.
