Work Permit and VISA Soon To Expire. TRV Applied

Thanks For your help Here is the problem.

Work Permit expires Oct 15 2014 along with my VISA. TFW from the Philippines. In Fast Food Alberta

Employer applied for new LMIA as he sent the wrong Docs in the first time and re submitted correct docs last week.


I have also applied to extend my stay by 8 months , applied online Sept 18th 2014.
My Boyfriend Gave me an Invitation letter stating he would cover all my expenses while visiting etc.

What happens if neither the LMIA or the Visitor Visa are approved by then.

How are my chances of being approved.

You applied to extend your status as a ..... worker? or as a visitor?

You are a worker so you can't extend a visitor status. If you applied for a TRV that is OK but it has no impact on your status nor in your ability to stay pass the expiration date of your work permit.

I don't fully understand what were the documents you submitted.... maybe it is better you ask this in the workers forum?

I am applying to extend my stay in Canada as a visitor. But also my employer has applied for LMIA as well.

My main concern is that they said to apply "about" 30 days before my work permit expires. However this isn't near enough time as they are working on Sept 10th applications as of today. And the 13th is a holiday so what can I do in the mean time while I wait for a decision.

OK, so you want to change your status from worker to visitor. LMIA has nothing to do with your extension request.

The 30 days is a guideline, which you complied as you applied on Sept 18th and your permit expires on Oct 15th, that is like 28 days, so that is perfect.

Enough time for what? Maybe you are asking for the period between your permit expires and the date you recieve the decision on your extension.

This period of time is called an implied status, that is you continue to hold your previous status (worker) under the same conditions until CIC reaches a decision in your case. As you have filed to extend your stay as a visitor you will be unable to continue working as soon as CIC reaches a decision. That day you will be either a visitor (extension granted) or without status (extension refused).

Then when you recieve a positive LMIA, then you can apply for a new work permit.
