Work Permit about to expire!! still waiting for PNP!! Advice needed

Hi Everyone,

This is my situation. My work permit (WHV) expires on October 7th. I submitted an application for a PNP through my company which was received on the 20th June. However due to a major backlog of applications at the BC PNP their estimated processing times have been pushed back drastically. I could be looking at another 8-12 weeks of processing time by which time my permit would have long expired.

I intend to send off an application for a new work permit (without the PNP certificate) a couple of days before my current work permit expires so that I will be able to continue working temporarily under implied status. I'm hoping that the PNP will send me the certificate before my work permit application gets processed. I know that if there isn't an LMO or PNP certificate with an application it will be refused eventually however I was told by a CIC representative that if I included a letter saying that my certificate would be arriving shortly I could get them to hold off processing the application by an extra week or so. The processing time for a new work permit is 20 days so I'm hoping I can get it pushed back to 30-35 days or so.

My main questions then are:

1) what do I do if the PNP still haven't got any closer to processing my application by this time? My company will not apply for an LMO so that option is totally ruled out. Are there any steps I should start taking to prepare for this worst case scenario?

2) If the PNP certificate arrives after my application has been refused what would I have to do next to begin working again and how long will it take before I can begin working. Will the PNP certificate even be valid if I am not eligible to work at that time.

3) Lastly if my partner sponsored me now would that grant me implied status? She's Canadian and we've been together for nearly 8 years so that should meet their requirements.

Any advice you can give will be most appreciated.

Apply for the extension of work visa before the expiry date of your current visa. This will give you implied status.

If your PNP does not come through before they reject the extension, then you stop work and leave Canada. Depending on the time line between both....you may be able to drive to Seattle and get your new work visa there. Otherwise, you will have to leave Canada and apply from your home Country.
