I need some guidance and help regarding applying for a Canadian PR through the CEC category. Here is a brief history of my situation hope that can help.

First time I came to Canada in Oct 2006 on a WX1 category visa for my employer from India to train/support Canadian employees and I left Canada on April 2007. After reaching India, my employer decided to send me back to Canada as the Canadian counterpart requested for me come and work for them. TRV and Work Permit were applied (as a Intra Company Transfee) to the Canadian Consulate in India and got them approved. I received the TRV (Category W1) stamped with a start date early Sep 2007 and I entered Canada on early Apr 2008, at the port of entry i was issued with the paper WP with expiry dated early Sep 2008 and was working. Canadian employer didnt move me in to Canadian payroll since at that time Senior management apparently decided for to send me back and did not put in me Canadian payroll, but I was still getting my monthly salary in India and daily allowance by the Canadian company with my loading been taken care by the Canadian company. My TRV and WP got expired dated early Sep 2008 and company applied before the expiry for renewal and continued to work. I got the renewed WP and Visa in June/July 2009. So from Apr 2008 to Aug 2009 even though I was working in Canada, I was getting paid in India and daily allowance here in Canada with loading taken care by the Company. Mid Aug 2009 on wards I was moved completely to the Canadian payroll and started to getting paid fully here and no pay in India, and I am working for the Canadian employer in Canada with appropriate work permits and TRV (expiring sep 2010).

Does my time spent in Canada with WX1 category gets counted against the 2yr requirement of CEC?
Do I qualify for to apply under CEC?
When can I apply for PR under CEC, If I qualify?
Since I was getting paid in India, I do not have a T4 for 2009 and I will be having T4 for 2010 in March. Is it ok if I submit the T4 which I will get in march 2010 ?
Can I apply without a T4, with just the letter from the employer?

1. Not entirely depending on when you submit your application. Only experiences within 3 years of your application date are eligible.
2. This will depend if IO will consider your work in Canada paid working experience. There is no specific regulation stating that you must be paid in Canada to consider Canadian work experience, however the common conception is that you are paid by your Canadian employer. You may want to seek professional advice elsewhere.
3. Depending on 2.
4. Send in what you have, again this really depends on 2.
5. According to the document checklist, a T4 is a required documents. There are exceptions when you can provide similar supporting evidence. But again they are exceptions, and most people don't fall under exception or it wouldn't be called exception anymore.

Finally, you should probably apply as FSW instead, then all your work experiences will count towards FSW requirements, that is assuming you can get a permanent job offer from your employer.
