My partner (Australian, 25) has visited Canada twice, both times on a six month tourist/visitor visa. The second time ( ending april 2016 ) resulted in her overstaying by 4 months. She departed without any problems (no notices of removal, deportation etc.) and we spent the year together in Australia. I've recently returned to Canada, because my Aus visa expired, and we are trying to figure out the best application for her to submit to join me here. Ideally this would be the IEC ( for work) however anything that grants her entry is fine.
Does anyone know the likelihood of being denied an IEC based on this previous infraction?
Because Canada does not have exit stamps, and she now has a new passport, what record would there be of her overstay?
Is there such thing as an acceptable reason for an overstay? ie if you provide CIC with compelling details of your reason for overstaying do they offer any leniency?
We've lived together for 2 years, does this qualify for common law/spouse?
Should we just apply for PR based on common law? If accepted how soon could she enter the country?
She has no other immigration infractions, proof of a job to return to in AUS, and meets all other requirements for IEC.
Ultimately we're looking for the fastest way for her to enter Canada.
