Will my spouse receive implied status?

Hi everyone,

My partner (American on visitor visa, expires April 30) and I are getting married at the end of February. We're hoping to get our marriage certificate by the end of March and apply for Inland Sponsorship at the beginning of April. After we apply, will he be on implied status or will he have to apply for an extension to stay?

Will you be including an OWP with your application?

If not, you will need to file for an extension, as the inland app does not grant implied status, only the OWP app does.

Even if you are applying for an OWP, I would still recommend filing for an extension as a safety net. Although the OWP application will grant implied status, many applications are unexpectedly sent back if anything is deemed incorrect or missing, and if that were to happen, your partner would be out of status and ineligible to apply for the OWP until he restored his status. Best to avoid that headache if possible.
