Hi there

my husband and I are expecting our first child in June 2021.

I am a British Citizen and Canadian PR holder and my husband is a Pakistani Citizen also a Canadian PR holder.

my question is given our circumstances; will our baby be eligible for canadian citizenship upon his/her birth in Canada? If both parents are PR holders at the time of a child’s birth but the child’s born in Canada are those acceptable grounds for Canadian citizenship for the child? Or do we need to wait until either one of us becomes a citizen first to then apply for our child to become a citizen? Please advise.

this decision will impact our decision on whether to give birth in Canada or the UK because I know our child will qualify to be a British citizen upon birth in the UK. Do the same rules apply in Canada regardless of my husband and I not being Canadian Citizens yet?

also please advise on what the process would be for my child were I to give birth in the UK and have them be a British Citizen then travel here with my baby. Will we then need to apply for baby’s PR? Is it the same long process as that of a spouse sponsorship or shorter?

thank you

If the child is born in UK, then you have to get the British passport. You have to apply similar to spousal sponsorship. Either by bringing your child in ETA/TRV and apply for inland, or apply as outland application.

Are you currently living in Canada? There are residency requirements to qualify for healthcare which vary by province but you and your child need to live in Canada for 6-12 months (depending on the province) or you can be asked to pay back any of the healthcare you receive.

Yes your baby will be Canadian by birth if born in Canada.
This is straight forward nothing to get confused in it.
