Visa Exempt - Decision Made: 02/09/2016
Hi Everyone,

This question is actually about my boyfriend. He has been living in Canada for the past 7 years on student visa, then work permits. He applied for PR 15 months ago. During that time he applied to re-new his work permit before it expired, however, while he was waiting for his new work permit the price of the application had changed, so instead of calling him to get the rest of the money, they sent back his application as in-complete. He completed his application properly and applied to restore his status within the 90 days he was given. He was worried that he would have to leave Canada right away, so he called immigration and they told him he did not have to leave the country while waiting for his status to be restored, except now he is unable to work. He has been out of work for the past 6 months, living off of savings. He has a condo here, a car, a driver's license, his life is here. He had to travel to the US last week and is planning on returning to Canada next Monday. Is he going to be denied re-entry since he does not have his PR yet and his status has yet to be restore? He has paid his "right of permanent residency" fee already and has done all of his finger prints and police reports. He took all of his paperwork and applications and receipts of payment, old work permits, etc. new and old passports. Copies of the finger prints as well as police reports with him so he can show the customs officers when he returns. He is a UK citizen so I am not sure how that will effect this whole process.

Any insight on this topic will help :)

Whoops I forgot what forum I was on, what method did he use to apply for PR?

He applied for his PR in Canada and I believe he applied on-line. I could be wrong though, we were not together when he applied. As for him leaving being a bad idea...he already left for the US last Wednesday...

They told him his processing time would be 12 months, then it was changed to 13 months and now they're saying mid-December. I guess best case senario they allow him to re-enter as a visitor since he is a citizen of a visa-exempt country, and hopefully the PR gets approved within the 3 months he's allowed to be here. Worst case they deny him entry into the country...I am just not sure what would cause them to do that, other than he left Canada while his PR application was still in process but there is no where that states that that is not allowed.

But through which immigration stream? Federal Skilled Worker? Canadian Experience Class? Spousal Sponsorship? One of the Provincial Nominee streams? Something else?

oh, that I am completely unaware of. If I had to guess it would be the Canadian Experience Class, but I am not 100 % sure on that.
